Board of Appeals Minutes - April 10, 1991 7. <br /> Comments cont. <br /> Kevin Harrington - Executive Secretary, Town of Mashpee - he said <br /> he had been working with Mr. Talanian and Mr. Jansson and Town Counsel <br /> for the past 6-8 months to resolve the problems of Donna's lane. <br /> Throughout this time Mr. Talanian has alluded to further development <br /> plans he has for the site but, due to the economy, would not be moving <br /> as quickly as he would like to. Mr. Talanian had discussed the multi- <br /> year permit for the flea market as a reason for investing some money into <br /> the site and making improvements which could benefit the community. <br /> Mr. Harrington said the only concern he has heard regarding the <br /> operation was from the business community asking for more aggressive <br /> regulatory measures. Mr. Harrington said this will be pursued. <br /> Peter DeNasio - said Town should help businesses which have been <br /> successful and provide a place for people to shop. <br /> Orrin Evans - Board of Health - situation on food sales will be <br /> discussed by the Board of Health on April 18. He said they are requesting <br /> a five-year permit and Board of Health may want to change requirements. <br /> Mr. Makunas asked for the following: <br /> 1. copy of the old Lease and the proposed lease <br /> 2. he stated they are asking for a multi-year permit but are not <br /> being specific on what they want to do. Mr. Makunas asked for <br /> plans on where tents will be located, how -close to road, appearance. <br /> 3. specific marked drawings <br /> G. differentiate between vendor's parking and customer's parking <br /> Mr. Boyd said any tent will require a Building Permit and Design Review. <br /> Mr. Jansson asked for a 5-minute recess. The Board agreed. Ms. Hawver <br /> adjouned the meeting at 9: 10 P.M. and meeting was reopened at 9:18 P.M. <br /> Mr. Jansson said the State Building Code does not say that a tent <br /> is a structure. He said he had a phone conversation with a member <br /> . of the Cape Cod Commission and that the Commission does not consider <br /> a tent a permanent structure. <br /> Mr. Jansson said they would agree to getting site plan approval <br /> in advance as well as Cape Cod Commission approval, if necessary, <br /> if the Board made this a condition of the Special Permit. If those <br /> terms were not acceptable they would withdraw the request for the <br /> tents at this time in order not to jeopardize the permit. <br />
