Cerni lia and Howard Feldman - Request a Special <br /> Permit under Section 174-25.1.9 of the Zoning By-laws for permission <br /> to construct a pier, gangway and float in an R-3 zoning district for <br /> the joint use of property located at 105 and 111 Waterline South <br /> Drive (Map 125, Blocks 246, 247, 248) Mashpee, MA. (Owners of record: <br /> Joseph A. and Nancy M. Cerniglia, Pamela C. Feldman TR and Christopher <br /> Burden TR.) <br /> Members sitting: M. Makunas, E. Govoni, J. Friel <br /> Engineer Douglas Cameron represented the applicants. He <br /> presented plans for a pier to serve two lots. He said the plan <br /> represented a 26% reduction in size from an earlier approved plan. <br /> Mr. Makunas read a letter from an abutter, H. J. Cohen, in <br /> opposition to the petition. Mr. Braman stated float could not <br /> be located closer to saltmarsh. <br /> Mr. Cohen identified himself in the audience and reviewed the <br /> plans. He said he was concerned that; the .water was very shallow and <br /> boats would be hitting bottom. Mr. - "responded that the depths <br /> were accurate and deeper than Mr. Cohen had understood. <br /> Mr. Friel moved to grant the Special Permit under Section 174.25.1.9 <br /> per plans presented. Mr. Govoni seconded. All agreed. <br /> Patrick F. and Carol J. Enright - Request a Variance from Section <br /> 174-31 of the Zoning By-laws for permission to vary the side set back <br /> requirement in an R-3 zoning district on property located at 27 Sand <br /> Dollar Lane (Map 105, Block 88) Mashpee, MA. <br /> Members sitting: M. Makunas, E. Govoni, J. Friel <br /> Daniel Buckley of New Seabury Engineering represented the applicants. <br /> He requested a continuance after hearing objections to the plans from an <br /> abutter, Mr. Bernaducci. Mr. Buckley explained that the Enrights property <br /> has retaining walls which have deteriorated. They would like to replace <br /> the retaining walls and add a garage. Mr. Bernaducci explained that he <br /> was concerned that the excavation will cause fall off onto his lot. <br /> Mr. Buckley said size of renovations will have to be negotiated. <br /> Mr. Makunas suggested plans be revised to be mutually agreeable. <br /> Mr. Govoni, suggested that the garage foundation might be designed to <br /> provide the retaining wall. There was discussion that new plans be <br /> submitted for the April 10 meeting reflecting the changes. <br /> Mr. Govoni moved to take the application under advisement. <br /> Mr. Friel seconded. All agreed. <br /> Mr. Makunas explained that the Board would have to make a <br /> decision before May 19 or that the application could be withdrawn <br /> and submitted at a later date. <br />
