Wastewater Treatment Facility(hereinafter"the Facility") located on District grounds <br /> shall be transferred to the Town. The Town shall be responsible for all repairs, <br /> improvements and maintenance necessary to continue the proper operation of the Facility <br /> and sufficient funds shall be appropriated within the Department of Public Works budget <br /> for School wastewater treatment purposes. The District shall continue to use the Facility, <br /> without any cost or expense, for any period of time during which the Town continues to <br /> be operate the Facility. In the event that the Town decides to discontinue the operation of <br /> the Facility, which the Town reserves the right to do at its sole discretion, the Town shall <br /> provide a sufficient, alternate means of waste disposal for use by the District, at no <br /> additional cost or expense to the District. <br /> In the event that the Town intends to make any repair, improvement or maintenance to <br /> the Facility, or in the event that the Town intends to discontinue the operation of the <br /> Facility and provide an alternate waste disposal site or system, the Town shall provide <br /> advance written notice and sufficient detail of such intended action to the District for its <br /> review, comment and concurrence. The Town shall not be precluded or delayed from <br /> implementing its wastewater treatmentldisposal plan for any School property or any <br /> Federal or State enforcement Order of Decree by the District's right of review, comment, <br /> and concurrence as stated in the preceding sentence. <br /> 4. Control of Buildings and Grounds <br /> The Town and the District recognize that the School Committee is and shall remain the <br /> policymaking body for the school system. The School Committee, consistent with this <br /> provision and with M.G.L. c. 71, shall, subject to the terms and conditions of this <br /> Memorandum and the duty and responsibility of the Town to fulfill its obligations <br /> hereunder, retain full jurisdiction and control over the use, access to, occupancy and <br /> rental of all District buildings, facilities, and grounds. Subject to the terms hereof, the <br /> Town shall not undertake any modification or improvement of District buildings and <br /> grounds without consent of the School Committee. Consistent with this authority, the <br /> Parties hereby acknowledge and agree to the following: <br /> 1 The dates and hours of operation of Mashpee Public Schools shall be established <br /> by the Superintendent and the School Committee, including but not limited to the <br /> scheduling of all school openings, closings, delayed openings, and early <br /> dismissals. Further, the Superintendent and the School Committee shall retain <br /> control over the scheduling of all school events, extracurricular activities, and <br /> summer programs on District property. <br /> 2 The right of access to District buildings and grounds shall be controlled by the <br /> Superintendent and the School Committee, including access by any media outlet, <br /> company, vendor, or contractor. <br /> 3 The School Committee shall maintain control over the use of District buildings, <br /> grounds and facilities by all groups wishing to use the District grounds and <br /> facilities.
