District properties, includingbut <br /> not limited to a schedule <br /> s to cover <br /> of the use of School buildings and grounds. The District agrees eto establish th <br /> tablishh and cost <br /> collect a minimum fee to cover custodian and energy costs, as well as <br /> administrative costs, incurred in connection with the use of District buildings and <br /> grounds. All fees shall be retained by the District in a special-purpose and/or <br /> revolving account established pursuant to the District's statutory authorities, <br /> including but not limited to M.G.L. C. 40, s.3. All fees shall remain under the <br /> exclusive control of the District and may be expended by the District for the <br /> upkeep and maintenance of District buildings and grounds. For any expenditure <br /> in excess of One Thousand Dollars ($1000.00), the District shall provide advance <br /> written notice to the Facilities Supervisor. Additionally, the District shall provide <br /> a written accounting of all monies received by and expended from the above- <br /> mentioned account to the Town on January 2 and July 1 of each year during the <br /> term of this Memorandum of Understanding. At the conclusion of each fiscal <br /> year during the term of this Memorandum of Understanding, any remaining <br /> balance in the above-mentioned fee account subject to M.G.L. c. 40, s.3 shall be <br /> paid to the General Fund of the Town and expended in a manner consistent with <br /> M.G.L. c. 40, s.3. <br /> 4 The District will maintain control over the scheduling of playing and athletic <br /> fields and facilities as required to meet the needs of the District's educational, <br /> intramural and MIIA athletic events, including practices. The District's use of <br /> such fields and facilities shall take priority over any Town use of the same. <br /> 5 The District shall maintain control over the use of all electrical, heating, <br /> mechanical, and air conditioning equipment and systems located on District <br /> property, with said use being consistent with good building management <br /> practices. <br /> 6 The District will maintain exclusive control over the drafting and implementation <br /> of any safety, emergency,evacuation and/or security policies, plans and <br /> procedures (hereinafter, "safety policies") for District buildings and grounds. <br /> Further, the District will maintain the exclusive control and possession, including <br /> the right of access and inspection, of any and all systems, devices, cameras, or <br /> equipment installed or maintained in connection with any such safety policies. <br /> 7 The Town will provide written notice to the District prior to the laying out, <br /> construction and/or reconstruction of any Town roads, ways or driveways on land <br /> abutting any District building or land. The Town, to the extent that it is a party in <br /> interest or entitled to notice with respect to any proposal to lay out, construct <br /> and/or reconstruct any private road, way, or driveway, including but not limited to <br /> any new means of ingress/egress for any commercial property, located in vicinity <br /> to any School building, shall notify the District of any such proposal and shall <br /> allow the School Committee to submit comment on behalf of the Town with <br /> respect to such proposal in conjunction with other affected Town agencies and <br /> departments. <br /> 6 <br />
