Michael Borselli, Falmouth Engineering, represented the applicant. He described the proposed <br />project includes the construction of an addition to the existing house at 28 Sampsons Mill Road. <br />He noted the application is also being filed pursuant to the Massachusetts Wetlands Protection Act <br />as well as the Mashpee Wetlands Protection Bylaws. He noted the resource areas have been <br />located which is a Bordering Vegetated Wetland which was an old abandoned cranberry bog. He <br />noted a perennial stream is near the proposed project which places the project in a riverfront area. <br />He noted on the plan the perennial stream and the inner and outer riparian zone. <br /> <br />Mr. Borselli noted the proposed work is located within the 100 feet of the resource area and <br />previously altered resource area buffer. The proposed work includes the construction of an <br />addition to the house and re-installation of the septic tank. The project will comply with the <br />mitigation regulations and the plantings will be planted in areas adjacent to the existing vegetated <br />buffer. He noted the project meets the performance standards. <br /> <br />The Agent referred to the visuals showing the property, addition, driveway expansion and <br />mitigation areas as well as the perennial stream channel. He noted the mitigation plantings would <br />be most effective which are to match what is growing there already and they are to be maintained <br />and monitored over a three year period. RDA <br /> <br />Resource Area: Coastal bank, buffer zone to coastal bank and BVW/Salt marsh <br /> <br />Raul Lizardi-Rivero, Cape & Island Engineering, represented the applicants. He explained the <br />proposed project is to modify existing rear deck and reconfigure stone walls and stairs in front of <br />the house and install new front landing. He noted the stairs in the front are in the road layout and <br />they are proposing to rebuild the stairs further away from the road and at the same time further <br />away from the salt marsh. The lawn will be replaced with plantings. All work proposed is located <br />within previously legally altered areas and all proposed work is located outside the 100’ to all other <br />resource areas. The limit of work will be installed prior to construction. <br /> <br />The Agent reviewed the project and showed some visuals of the home and the steps. He noted <br />the very steep coastal bank and showed the area of mitigation as proposed. He said originally <br />mitigation wasn’t proposed but his recommendation is to have mitigation because of the proximity <br />of the deck to the wetland resource area, it is inside 50’ of the BVW and its over the bank itself. <br />Given this, mitigation was warranted here and the mitigation was added to the plan. <br /> <br />No comment from the public <br /> <br />Motion: Mr. Sweet moved for a Negative Determination with the conditions as suggested by <br />the Agent, seconded by Mr. Shaw.
