Motion: Mr. Smith moved to continue the hearing at the request of the engineer to April 26
at 6:03 p.m., seconded by Mr. Sweet. Vote unanimous5-0

6:09 Verne T. Porter, Jr., 23 Riverside Road. Proposed reconstruction of existing bulkhead
and pilings within same footprint. NOI

Resource Area: LSCSF, Land Under Ocean, Salt March, BVW and Land Containing
Shellfish

Verne Porter, applicant, explained the proposed project consists of the reconstruction of the
existing bulkhead and the replacement of the existing piles with new wood piles and replacement
of the horizontal wood portions with corrugated vinyl sheeting to be attached to the piles. The
construction will match and be continuous with the recently permitted bulkhead on the property to
the south. He noted the proposed construction on the site plan. He noted the site was not located
in the rare species habitat.

The Agent showed some of the pictures of the remnants of the existing bulkhead and the salt
marsh. He noted it is a previously licensed structure and the applicant has the right to rebuild it
according to Chapter 91 as long as it is built in the same footprint. The Agent referred to a letter
from Marine Fisheries and stated the comments can be conditioned into the Order of Conditions.
He said there may be some impact in the salt marsh area which is not shown on the plan and
recommended a revised plan to incorporate the additional salt marsh areas into the plan. He said
he didn’t see any staking of the corners of the project and would make that a condition prior to
construction.

No comment from the public

Motion: Mr. Sweet moved to Close and Issue with the conditions recommended by the
Agent that the salt marsh is delineated on the plan, seconded by Mr. Smith. Vote
unanimous 5-0

6:12 Charles A. Cheever, Trustee, 168-S South Sandwich Road. Proposed reconstruction
of retaining walls, decks, decking, railings, landings, stairs and tree pruning. NOI

Resource Areas: Buffer zone to coastal bank, coastal bank and Land Under Water Bodies
and Water Ways (Mashpee Pond)

Tim Santos, Holmes and McGrath, represented the applicant. He explained the proposed project
is the reconstruction and maintenance of existing timber deck, landings and stairs, the replacement
of an existing timber retaining wall with a stone retaining wall, the replacement of the existing
timber steps to water, the replacement of the existing timber decking a railings for the lakeside
deck, tree pruning and the replacement of a portion of the timber retaining wall adjacent to the
lakeside deck. The work will take place on an inland bank and within 100 feet of the inland bank
and pond. A construction of limit of work will be installed. There will be minor trimming of trees
adjacent to the lakeside deck. The existing timber steps to the water are deteriorating and will be
replaced. The proposed structures are placed no closer to the wetland resource areas than the
present structures. He noted the proposed construction will maintain and improve existing
