He reviewed the proposed project of a new single family <br /> dwelling with attached deck and one car garage, construction of two retaining walls, placement <br /> of an onsite I!A septic system, construction of a paved driveway, placement of a leaching basin, <br /> and landscaping of all disturbed areas. He referred to a letter submitted by the applicant in <br /> which she stated she owns the property and bought the property a number of years ago and <br /> was hoping the sale of her property would be for her retirement. He reviewed the mitigation <br /> plan and stated there is a great deal of detail in the plan. He said because of the input of the <br /> Commissioners, they moved the leaching pit and placed a leaching trench directly below the <br /> deck. He described the limit of work and the path leading down the coastal bank with no trees <br /> to be chit down. He explained there was not enough land to come up with the necessary <br /> mitigation f-or this lot per the regulations because the entire lot is subject-to the mitigation <br /> requirements. He stated the mitigation plan presented shows 944 plants and an additional 682 <br /> plantings would be necessary to meet the regulations and there is no available space to do so. <br /> He noted Board of Health approved plans, with variance relief for a Title v leaching facility with <br /> an I/A to accommodate a proposed three bedroom dwelling. <br /> The Agent stated he has not had a chance to contact town counsel regarding alternative <br /> mitigation because there is nothing in the regulations allowing for alternative mitigation. The <br /> Agent review regulation 172-7 which is the criteria for waiver requests. He stated the planting <br /> plan is an aggressive plan and felt the performance standards have been met for the bank and if <br />
