MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> APRIL 11,2018 <br /> Attorney Kirrane said that the road does not meet sub-division road standards. It certainly <br /> meets the harden surface requirement relative to the Fire Department letter and other <br /> requirements that are set forth in his CMR regulations that he references in his letter. There <br /> will not be the 20 ft. that is required under the zoning bylaw,but there is a request for relief <br /> for the 20 ft, required with the Variance request. The Chief is satisfied with the pruning <br /> that was addressed up to the height that he requested, and will have no difficulty with a <br /> truck to gain access to any of the properties on Amy Brown Road. <br /> Chairman Furbush asked if Charlie Rowley, Consulting Engineer be involved with this <br /> project to review the project regarding the drainage. <br /> Associate Member, .Sharon Sangeleer commented that her former residence was on a <br /> private road that was unpaved and had serious drainage issues. She said; in order for the <br /> Town to take it over, the residents would have to bring it up to code. It was a safety issue. <br /> She said there was a skim coat on it, but because it was not installed properly it eroded <br /> within five years. <br /> Attorney Kirrane said that Amy Brown Road is an ancient way from the 1900's, and there <br /> was no requirement.under the zoning bylaw to create a subdivision roadway that would <br /> conform to all requirements under the subdivision control law relative to drainage. The <br /> issues that were raised, and the objection that was raised by the Fire Department was would <br /> they have safe access to these properties, and the letter submitted is that he is satisfied and <br /> is comfortable that it will provide the access that is needed under that particular section of <br /> the bylaw. All the neighbors are contributing to construction of this roadway. <br /> Mr. Mendoza made a statement that if the Board wants to place a condition for this <br /> application; that Amy Brown Road is not a Town accepted road until the road is brought <br /> up to Town standards. Any drainage issue(s) is not a Town issue. (No Town Departments <br /> get involved). <br /> Attorney Kirrane said his client would agree to a condition before any building permits are <br /> issued for the construction of a home on the lot,that the paving etc. be complete. <br /> Mr. Brad Sweet, 13 Amy Brown Road an abutter addressed the Board and submitted a <br /> letter for the record. He is very supportive of the project. He believes the Road is perfectly <br /> flat, and said it will be gated at the end of the normal travelled way momentarily. He said <br /> he has been working with the Waquoit Bay Estuarine because there thirteen entities at the <br /> end of Amy Brown Road. <br /> Mr. Tim Leedham, 61 Amy Brown Road, an abutter addressed the Board and commented <br /> that he is in favor of the new home project. He said that all the neighbors are working <br /> together on the road improvements. <br /> Scott Goldstein made a motion to approve the withdrawal of the Appeal of the Building <br /> Commissioner's Decision of 31 Amy Brown Road. Mr. Gould seconded, yes, Mr. <br /> Blaisdell, yes, Mr. Furbush, yes, and Mr. Pittsley, yes. <br /> 2 <br />
