reflecting the Goals of The Town of Mashpee to maintain Cape <br /> Cod-style of development . <br /> Selectman Marters asked if any of the buildings being <br /> proposed would be higher than the current thirty-five foot <br /> height restriction. Mr. Storrs answered, "No. " <br /> Selectman Marsters recognized Mr. Baker who interpreted the <br /> discussion to mean that this Bylaw would allow for a reduction in <br /> the vegetated buffer. He also raised questions regarding lot <br /> coverage, impervious surfaces, and artificial recharge. He <br /> commented on the area of vegetation at the existing Mashpee <br /> o mn ns as, "Not a heck of a lot. ,, He commented there does not <br /> appear to be a lot of vegetation shown on the proposed plan <br /> either. He stated the proposed Bylaw, by allowing a setback <br /> reduction and allowing the Planning Beard to further~ reduce it, <br /> does in fact allow for less vegetated areas on the land. <br /> Mr. Fudala explained the Bylaw would not allow any changes <br /> unless a separate set of dimension standards are allowed by the <br /> Panning Board. The only requirement for any type of vegetation <br /> within the current Zoning Bylaw is the fifty o foot buffer <br /> along Route 28 . However, landscaping is required by the Sight <br /> Plan Review, Design Review, and the Planning Board. In addition, <br /> the cape Cod Commission requires areas of open Space. <br /> Mr. Pudala further explained that the issue of artificial <br /> recharge referred to by Mr. Barer relates only to the groundwater <br /> protection districts, it does not apply to the vast majority of <br /> conunercial areas of the Town. There is no requirement at all in <br /> terms of impervious surface coverage in the existing or proposed <br /> Bylaw. Restrictions for impervious surface coverage only apply <br /> to groundwater protection districts for water supply wells that <br /> refer to an artificial system of recharge that will not <br /> contaminate ground water. <br /> Mr. Marsters asked for a brief explanation of differences <br /> between the existing and proposed Bylaws . <br /> Mr. Pud.ala explained that under the current Commercial <br /> Center Bylaw, Mashpee Commons could build a Shopping Center <br /> consisting of multiple uses. The Bylaw being proposed would <br /> allow property limes to be drawn in between the buildings along <br /> Market Street, or to separate the Stop & Shop building from the <br /> others. In addition, the buffer~ area could be reduced by a <br /> waiver granted from the Planning Board. There are deed <br /> restrictions dealing with parking and wastewater. The <br /> architectural codes would be much stricter. <br /> Mr. Whritenour interpreted the proposed Bylaw as being more <br /> protective of the Town by way of implementing architectural <br /> guidelines, and the ability to address wastewater issues .
