NOI <br /> Resource Area: Coastal Bank, Coastal Dune, LSCSF, Buffer Zone to Coastal <br /> Bank/Dune/Beach <br /> Andrew Garulay, Yarmouthport Design Group, represented the applicants. He reviewed the <br /> proposed project using the plans on the screen which consists of the removal of the egresses on <br /> the landward side of the house, proposed window wells, removal and replacement of concrete <br /> driveway, a mitigation plan, reconfiguration and reduction of 2nd story deck, removal of poured <br /> concrete patio to be replaced with dry granite patio and stepping stones, the removal of non-native <br /> Rosa Ragusa and other invasive plants to be replaced with American Beach Grass, proposal of <br /> wood framed stairs to beach which depends on approval by the Popponesset Beach Association, <br /> and the extension of a privacy fence to replace the evergreens. A hot tub is proposed with the <br /> footprint of the reduced driveway with a gas fire pit and grill. He also noted proposed are gutters, <br /> downspouts and drywells. He stated this request meets the performance standards and will <br /> improve the buffer and habitat. <br /> There was a lengthy discussion on the runoff from the driveway and the Agent suggested pavers <br /> rather than as halt. The Agent noted that the Popponesset Beach Association will not allow steps <br /> on their property at the toe of the bank and beach. He wanted to note it didn't make any sense to <br /> have a stairway to nowhere and if the steps are not allowed, the steps should be eliminated from <br /> the plan. The Agent reviewed the images of the property and the hardscaping and landscaping <br /> proposed. He also noted the proposed restoration area. <br /> Public <br /> Marian Oost-Lievensky, Member of the PBA Board, stated they will not allow the stairs to be built <br /> over their property. With regard to the plantings, there is a marker showing the boundary on the <br /> property. She said in conjunction with the Agent and the homeowners the issue of the invasive <br /> plants can be discussed. She said they prefer a natural kind of fencing on the property. <br /> The Agent stated as far as everything that has been proposed it meets the performance standards. <br /> John Kreman, represented Family Realty Trust, asked how this would affect the drainage for 23 <br /> Elliott and would it get worse or get better. Mr. Garulay said they will shorten the driveway and <br /> repave it and will be adding drywells. There was a suggestion to add a berm to keep the water <br /> from Clover Lane and Clover Lane property. The Agent stated a condition could be put into the <br /> Order of Conditions that the homeowner is responsible for drainage and runoff from his property. <br /> Harold Clark, PBA, was concerned with the drainage coming off the property onto Clover Lane. <br /> There was a lengthy discussion on the drainage, pavers, wagon wheels on the driveway. It was <br /> determined that if the Commission approves the project details, this issue could be discussed with <br /> the Agent and approved before the Order of Conditions is issued. It was also agreed that the <br /> invasive species removal would also be approved. <br /> Motion: Brad Sweet moved to Close and Issue with the conditions as discussed and that <br /> the Engineer and the Agent come together to come up with a solution in regards to the <br /> surface water on Clover Lane and Elliott and to remove the stairs from the plan and the <br /> invasive control is acceptable.. Seconded by Mr. O'Neill. Vote 3-1 with Mr. Anderson <br /> opposing. <br />
