q <br /> James Hirbour, potential buyer for the property located at 76 Surnmersea Road, introduced himself to the <br /> Board. Mr. Hirbour answered the Board's questions concerning the use of the property. <br /> Laurel Almquist made a motion that the Board of Health approve the variance at 76 Surnmersea. road with the <br /> condition that the buyer, James Hirbour, enter into an enforceable agreement with the teras of the enforceable <br /> agreement submitted within 7 days and the system engineered and completed within gg days from the date of <br /> transfer. Mallory mangler seconded the motion. The motion was unanimously approved. <br /> 6. Request for Temporary Food Permit: Boys & Girls club (Awesome chili challenge). <br /> Glen Harrington remarked that the Awesome chili challenge includes participants who are not from licensed <br /> facilities but are considered amateurs. The restaurants are considered professionals. The amateurs cannot <br /> have the public taste the chili (if it is neat-based), as a residential kitchen cannot serve potentially hazardous <br /> foods to the public. Only the judges would be allowed to taste the chili. Therefore, the professional contestants <br /> and the amateurs will produce their chili in a licensed facility allowing the public to judge all of the participant's <br /> chili. The list of participants have been provided by the organizer. The event is a fund raiser for the Boys & <br /> Girls club and the Falmouth service Center, and both are nonprofits. No fees are typically charged for permits <br /> or inspections. <br /> Laurel Almquist made a motion that the Board of Health approve the Temporary Food Permit for the cape cod <br /> Awesome Chili Fest at the New seabury country club with the following conditions: <br /> `I. All food shall be prepared in a licensed food establishment. <br /> . Cate Sampson shall be assigned the certified Food Manager onsite. <br /> . The temporary food permit fees shall be waived. <br /> 4. An inspection by a Health Agent shall occur prior to serving the food. <br /> Mallory Langler seconded the motion. The motion was unanimously approved. <br /> ADDITIONAL TOPICS <br /> Nonek <br /> DISCUSSION <br /> 1. Innovative Alternative sampling Requirements. <br /> Glen Harrington commented that he forwarded the Board information on the Innovative Alternative sampling <br /> Requirements. If the Board feels it is worthy of changing the regulation, Mr. Harrington will advertise the <br /> regulation in the paper for two consecutive weeks prior to a public hearing. Mr. Harrington is proposing to <br /> reduceleliminate the total nitrogen quarterly sampling requirement and increase the maintenance of the <br /> Innovative Alternative septic system. <br /> The Board and lir. Harrington discussed the requirements. The Board requested that Mr. Harrington advertise <br /> the regulation for a public hearing to occur on March 15, 2018. <br /> 2. Draft Rental Property Regulations. <br /> Glen Harrington remarked that due to the issues that have arisen from the abuse of properties by homeowners <br /> and renters using the on-line vacation rentals, a draft rental property regulation was prepared for the Board's <br /> consideration using guidance from the Department of Public Health and the Barnstable and Falmouth existing <br /> regulations. Per Brian Baumgaertel's request Mr. Harrington included the Provincetown regulation which <br /> contained very useful information. <br /> Mr. Harrington recommended that further discussion tape place on the rental property regulation for a final <br /> product to be sent to the real estate businesses and property owners in Mashpee for feedback for a Public <br /> Hearing. This must be completed prior to February 12, 2018, in order to create an Article for the May Mashpee <br /> Town Meeting to establish and fund another position for the Board of Health. The Board agreed to a special <br /> work session meeting to finalize the Rental Property Regulation. The date for the work session was set for <br /> Tuesday, January , 2018, at 7:00 PM at Mashpee Town Hall. <br /> 3 <br />
