Hendler - Request a variance under <br /> Sections 174-31 and 174-33 of the ZoningBy-laws for <br /> permission to vary the setback requirements and build <br /> within fifty ( 0 ) feet of water on property located in an <br /> R-3 zoning district at 166 Popponesset Island Road (Map <br /> 112 , Block 1 ) Mashpe , MA. <br /> Members sitting: E. Hawver,, K, Iarstrs <br /> Attorney Kevin Kirrane represented the applicants, He <br /> presented plans for the replacement of a dwelling which <br /> does not have a f oundat ion which conforms to current flood <br /> plain construction requirements , He said the proposed <br /> reconstruction will permit substantial improvement to the <br /> existing site conditions and will include a new septic <br /> system, reduction in number of bedrooms from 6 to 4. <br /> replacement of a concrete drive with a pervious crushed <br /> stone drive- and drive-andreduction in -lawn area which will reduce <br /> nitrate loading by one third. Lot coverage will be 17 . 7 . <br /> M . Kirrane said the new structure would be a substantial <br /> improvement and presented elevations of the house. Mr . <br /> Kirrane questioned if Variance relief was necessary. Mr. <br /> Govoni stated he did not think a Variance was necessary but <br /> it could be kept under advisement. <br /> Ms . H awver moved to take the Variance application under <br /> advisement. Mr, Marsters seconded. All agreed. <br /> Hawver moved to grant the special Permit , Mr. Marsters <br /> seconded. All agreed. The Permit is subject to approval <br /> by the Conservation Commission and the Board of Health. <br /> i <br />
