MINUTES ! May 2 , 1991 2 BOARD OF HEALTH <br /> Board members agreed.. <br /> Mr. Costa recommended' limiting recycling to three days a <br /> week, preferably Wednesdays and weekends. <br /> APPOINTMENT: Donald McCauley - Occupancy permit, 58 Yardarm <br /> Mr, McCauley was in attendance for this scheduled ap- <br /> po i ntme nt. <br /> I <br /> Mr. Doherty stepped down from this issue as he found it <br /> to be a conflict of interest. <br /> Mr. McQuaid relayed the installer has not submitted the <br /> "As Built" card due to nonpayment. "I t is this Boards policy <br /> not to sign-off on occupancy permits until both "As Huilts" <br /> have been submitted, " "The installer has verified that he is <br /> withholding the 'AAs Built" card until payment -is received <br /> however, is willing to make financial arrangements with Mr. <br /> McCauley. " <br /> Mr, McCauley stated financial discrepancies between two <br /> parties is no business of the town. "The installer should be <br /> required to submit the "As Built" whether there are financial <br /> problems or not. " <br /> Mr. Costa explained the "As Built" card verifies that <br /> the system was installed by the 'individual who was issued the <br /> septic permit. <br /> Mr. McCauley stated the town cannot act as an agent for <br /> the installer, "The installer should have placed a lien on <br /> the property. " <br /> Mr. ' Costa informed Mr. McCauley the card certifies that <br /> the installer performed the work. <br /> Mr. Creelish informed Mr. McCauley this Board has estab- <br /> lish d precedent as to how this type of situation is handled. <br /> "The only way in which this Board can avoid acting as an en- <br /> -forcer or .collector is to require some verification that the <br /> *s t m was " installed. 111 "'This Board would accept an "As <br /> ' Built " from another "inst ller7 if the problem cannot be recti- <br /> fied:" <br /> ecti- <br /> fied:" <br /> ti <br /> P 4�. <br /> A OI TME T: 3'Lynn Watermann !4- Health Serviqes <br /> a Ms. Watermann was in attendance for this scheduled ap- <br /> ointment.
