Extract from Minutes of January 6 , 1982 page 4 . <br /> BOARD OF SELECTMEN <br /> • ELIZABETH SIMPSON RE: SOUTH CAPE BEACH <br /> Chairman Garland recognized Elizabeth Simpson, who asked <br /> to speak to the Board on the subject of South Cape Beach. <br /> Mrs. Simpson raised the following questions : <br /> Due to the turn of events , -;does the Town have to go <br /> through the same routine as previously when the new <br /> session of the Legislature opens , in order to bring <br /> the South Cape Beach issue before the General Court? <br /> Do the Hearings have to be held again? Does there <br /> have to b e a new appraisal? If so, who will .pay <br /> for the appraisal? <br /> Chm. Garland opined that since the State had paid <br /> for the prior appraisals, he would assume they would <br /> pay if new ones were required. <br /> Sel. O'Connell said that whether or not new appraisals <br /> are required will depend on how soon it comes before <br /> the Legislature. He said the new session was starting <br /> this afternoon, and that the leadership had promised <br /> to bring the Bill out promptly. If it is heard in a <br /> month or two, presumably the old appraisls will suffice. <br /> If it takes as much as 6 months , it may necessitate <br /> new appraisals . <br /> • Elizabeth Simpson then asked what is happening to the <br /> interest that is accruing on the money that has been <br /> set aside for the taking, is it being returned to the <br /> original fund? I think it is important that we find <br /> out about this , she stated. <br /> Sel. O 'Connell said these questions should be posed to <br /> Jerry Cahir. <br /> Sel . Thomas said we should get a letter off to the <br /> South Cape Beach Advisory Board Chairman, enumerating <br /> these questions . <br /> Chm. Garland then questioned what effect, if any, the <br /> new indian suit might have on the State taking? <br /> Sel. O 'Connell recalled that it had caused the taking <br /> to be abandoned when the first suit was instituted in <br /> 1976 . <br /> Elizabeth Simpson said she feels the representatives on <br /> the Advisory Board from the other communities are dragging <br /> their feet. They should be pushing their representatives. <br /> She said we should all be pressing for favorable action by <br /> the governor. <br /> Ms. Simpson wonders if the Legislators are aware of the <br /> restrictions and prohibitions on this land? Very little <br /> of it is buildable. we 'd better working on these things! <br /> Chm. Garland said we would put these questions to Rep. <br /> Cahir promptly. <br />
