i . <br /> General Order - Page 2 <br /> Use of Sobriety Checkpoints <br /> for OUI Enforcement <br /> B. For the safety of officers and general traffic, vehicles should <br /> be, when possible, directed by means of warning signs, lights, <br /> traffic cones or other safety equipment into a single traffic <br /> lane. <br /> C. All vehicles shall be required to stop at the checkpoint except <br /> as outlined in this order. Portable stop signs in .addition to <br /> the directions of a uniformed officer shall be utilized for <br /> this purpose. A staggered stop of all vehicles shall be employ- <br /> ed, that is, all vehicles will be asked to halt a distance of <br /> thirty (30) to fifty (50) feet from the contact officer. As the <br /> contact officer concludes speaking with the occupant(s) of a veh- <br /> icle, (or has that vehicle pulled off for further investigation, <br /> in which case a new contact officer shall be designated) the next <br /> vehicle waiting shall be signalled to pull forward and then stop <br /> in the immediate vicinity of the contact officer. This will al- <br /> low the contact officer to observe the driver operating the veh- <br /> icle. If sufficient manpower is available, two contact officers <br /> may be employed simultaneously, alternating their contacts. <br /> D. Adequate off-street parking for any follow-up investigation shall <br /> be available in the immediate vicinity of the sobriety checkpoint. <br /> It shall be the responsibility of the Chief of Police or Deputy <br /> Chief of Police to insure that permission has been obtained from <br /> the owner or agent of any private property or parking area used <br /> for this police purpose. <br /> Contact with Vehicle Operations at Sobriety Checkpoints <br /> A primary purpose of the sobriety checkpoint is to increase both the <br /> actual and perceived risk of the drunk driver being detected and arrested. <br /> In accomplishing this purpose, the support and cooperation is essential. <br /> The Mashpee Police Department must make every effort to insure that a min- <br /> imum of intrusion and inconvenience of the public occurs and that enforce- <br /> ment efforts do not create a greater hazard than the one we are attempting <br /> to reduce. The following guidelines shall be followed in an effort to ac- <br /> complish this end: <br /> A. The contact officer must be in uniform to insure the public that <br /> a sobriety checkpoint is a legitimate governmental operation. <br /> B. The contact officer will approach each stopped motorist and state, <br /> "I am Patrolman (John Law) of the Mashpee Police Department. You <br /> have been stopped at a sobriety checkpoint set up to identify <br /> drunk drivers" . <br /> I <br />
