General Order - Page 4 <br /> Use of Sobriety Checkpoints <br /> for OUI Enforcement <br /> F. If during this initial contact, the officer established a <br /> reasonable suspicion that the driver may be impaired, the <br /> suspect should be advised to pull into an adjacent area out <br /> of the traffic flow and then requested to perform a series <br /> of field sobriety tests. Persons who demonstrate to the <br /> officer that they are obviously not able to safely move their <br /> vehicle to the field test area should not be allowed to drive. <br /> G. If such reasonable suspicion does not exist; the driver will <br /> be allowed to proceed. <br /> Further Investigation <br /> A. Suspected impaired drivers shall be processed in accordance <br /> with 'Mashpee Police Department procedures (General Orders, <br /> Rules, Training Bulletins) . Contact officers participating <br /> in the operation shall administer such tests as practical and <br /> in accordance with their impaired driver detection training. <br /> As much as possible, the test pattern and conditions shall be <br /> uniform for all suspects. <br /> B. The officer making the initial contact with the driver shall <br /> remain with that driver throughout the investigation and ar- <br /> rest process (if an arrest is made) , and shall be responsible <br /> for conducting all field sobriety tests, and shall complete the <br /> necessary documentation reports, covering all phases of the <br /> sobriety checkpoint operation. <br /> C. If the contact officer subsequently determines through field <br /> sobriety testing that the driver is not impaired, then the <br /> driver shall be released. <br /> Supervisory Responsibility <br /> A. ' A supervisor shall be present at field sobriety checkpoints at <br /> all times. <br /> B. If the on-scene supervision of the checkpoint determines that <br /> a hazard is being created by an excessive back-up of stopped <br /> vehicles, he may terminate the checkpoint for a period of time <br /> in order to relieve congestion. <br />
