It was brought to ray attention, ah Joe, `....: � :•_, ,..,.... that there was a contract that had been signed by the Board ectren to a (ah) Dave Aubrey, I guess, After the contractway i ned and the ah way approved by fou throghou t entire con tra t p the name of the person that the town was doing business with had been charged. So I gust think that there i some clarification due here . And my question i , ah the fact f that we are no longer doing buiness with a Dave Aubrey but ars q Aubrey Consulting, Incorporated is what impact there is possibly on the town through this contract , our coverage, the whole nIn'e yards that's involved there . I don't know. I.m just closed :r + W1*A MY mind as far as who a are dealing with now or what w are dealing- with now, and their responsibilities and our I i abr I r U ..: +�� f. and vice versa. ,.. . ill.' el . Ah When the contract was typedup ,� ,a.: : it was typed up for the individual of David Aubrey and David gave rye a call last week and he asked me to substitute Aubrey }ri Consulting Incorporated. Which I did. I did that on 4our contracts because I understand that we need three contracts to be 5t legally signed. I did not realize that by doing this I just thought we sere dealing with the same person) I gust did not realize that the I i ab i 1 i ty was d i fferen t f rom an i nd i v i dual to the corpor*at i on. was very, very upset when I learned from Town Counsel through letter that the change and substitution of the name created a concern in teras of the l i a i l i ty, We were now dealing with not with the individual but with a corporation and that ah he brought this to my attention through the letter . I was horrified. I was embarrassed. I was ashamed, ah I immediately ah Dave Aubrey was coming back from his vacation on Tuesday. One of the purposes was to sign the contract . I met with him at the Woods Hole Institute and ah brought to him Town Counsel os letter and ah told him how concerned I was about this, e has been incorporated s i nce' May of 1985. And as luck would have i , he had received a call on Tuesday that he did have the l i abi 1 i ty insurance granted to h imf Um With that , I asked him you snow if I could have a copy of the warrant of articles of his corporation and his alp I guess they call it a binder. I'm not sure, He did not have it as he gust received a telephone call and probably wou l dn-"t have it for a couple of more weeks. I would say to the Board that number I , I'm embarrassed, I"m ashamed and I'm sorry that this thing happened. I would also say to the Board that ah we could, if you so desire , ah get hi to sign the waiver incorporation and/or rescind that and get the ah accept the insurance that he now has which we had requested originally., So with that, I Mate ray case that there was no i n ten t , no real i ce whatsoever on ray par t .
