Thomas: l l , my first reaction , ah realizing t h
liability concern was to get that l i bi l i t for the town. That
was my first , you know, thought. I was gust very concerned about;-,:
that that liabilitything that was in the um the contract. ;4
And I understood that um Mr . Hanson had come into the office., f', ti
had acquired the contracts and taken them to you to review, T h a
YOU had discussed ah and loaned at these contracts. So I knew
you were aware of the important mistake ,
e l . Hanson: It wasn't quite that way but we won't dwell on i t ,
eani All right .
el . Lawrence: Well , I have , I have some questions that I'd 1 i e
to address the Town Counsel . ah Obviously, this is not a
signed contract because we signed it as three members of the
Board of Selectmen, Dr. Aubrey. had not signed it so it's not a
legally binding contract.
Town oun l * That's right . What that document was was the
cu lmunat i ori of um negotiations if I can call it that , They
really weren' t negotiations, We had agreed in principle right
along with Dr . Aubrey and I had prepared a contract and submitted
it to him. The contract I had originally prepared and submitted
to him called for him to provide to the town a l i abi l i t policy
which is standard operating procedure . This and ever since I've
been Town Counsel , I have always requested that anybody furnish—
ing
r nish—
ing sereices to this Fawn offer proof to the Town that they have
some form of l i bi l i t insurance i n place to protect the Town in
the event that they, or their emp 1 c,`fC .S, in the course of their
work cause harm to somebody. h Because the Town is sure a big
target and we get sued everytime one of our agents does something
Everybody jumps right on the band wagon. They figure they can hitt a homerun against the Town . So, it's very important that we
have some protection. h Dr . Aubrey indicated that he was
unable to get this type of insurance * (Ah) And, he ah went to
his attorney, who is Stephen Rathaport , and Steve dreg up an
addendum, a document that w "so—called" addendura to the agree—
ment .
gree—meat . Steve prepared that after he had talked to me and I
suggested that he prepare what he felt was appropriate and send
