He said, "It appears that approxi- <br /> mately <br /> pproxi- <br /> ma.tely ten years ago there was an agreement drawn up between the <br /> l akepeace people and the State stating that if they were negligent <br /> in controlling the level of the Pond , they would be held liable to <br /> the people that live around John's Pond for any damages that were <br /> created. we obtained the property the Town from the lakepea.ce <br /> people and l assume that type of agreement transferred to us , we <br /> have not had a legal de c is 'ion on i t . At the meeting with the cran- <br /> berry growers it appears that they would like to have a. certain <br /> amount of control over the flume . l suggested that they could have <br /> total control over the flume . All they would have to do is accept <br /> total responsibility. The growers rejected this suggestion and <br /> counter-suggested to work with the Town concerning this situation. <br /> They agreed to set dates and tunes for opening and closing the flume . <br /> At that point , John va.rc nda , the Conservation officer, agreed to <br /> assume the responsibility of the flume at the northern end of John's <br /> Pond. " Mr. Hanson reported that Mr. Peterson, who lives on the <br /> other side of the Pond and who has lost over eleven feet, of ,propert y <br /> over the nineteen years he has lived there , cage to Mr. Hanson again <br /> with concerns that the levels seem to be building up again rather <br /> than decreasing. Mr. Hanson stated that he met with Mr. Varconda <br /> earlier this week and Mrs varc onda. informed hien that he is going to <br /> meet again with Mr. Peterson and three or four other waterfront <br /> property owners , Mr. Manson and Mr. Virgilio will also be present. <br /> Chairwoman Thomas reported on the status of Popponesset <br /> dredging, she stated that the Town has received the specifications <br /> and bids , She further noted, `ewe are in advertisement. Bids will <br /> e received June I , 19870 " <br /> Mr. Murphy reported on the status of Ms . Rubin's work- <br /> related injury. He stated that she did have surgery on Friday and <br /> should be back to work in a. week' to tern days <br /> New Business : <br /> 1. Planning_ <br /> Board - Letter o Interest. The Executive <br /> i.i� i - i■it i�r_�mrr.✓t�i�i�r�r..✓•r. <br /> Secretary stated that the Planning Board has received a letter of <br /> interest dated la. r 5P 1987 from Donald Blakeman. of Cr'anber'ry Lane . <br /> The Planning Board and the Board of selectmen will meet jointly to <br /> consider candidates for appoint to fill the vacancy on the Planning <br /> Board. <br /> 20 Mash - Wampanoag Indian Tribal Council re : Pow Wow, <br /> Mr.. „r'phy re'f e rre d to a letter dated pri l 27 , 1987from Joan <br /> Tav s _.-1 re s1dent of _the Council in which it was requested to <br /> again use the D. uglas Pocknett Ba lfield behind the old Town Hall <br />
