MAY 25r 1989
PAGE TWO _
Selectman Gottlieb' asked o f the 1981 Agreement stated that the town
beach should be roved to its present location.
Morris Kirsner stated positively. The Agreement has attached to it
a diagram of the new town beach. It also has attached to it aproc-
lamation by f r'mer Goer. King relative to the development of the new
town beach recognizing there is a sand dune there that is now covered
by the parking lot and that would be removedand the dune would be re-
stored. In Paragraph 7, it states : "In conjunction with its terns,
the Department ent should make improvements to Great oak. Road at the in-
tersection of Red Brook Road, all the way to the beach. In addition,
the Department will assume the cost for the relocation of the town
beach, including the cost of the new access road, parking areas and
necessary fencing, and other essential improvements . Said town bead
will be to the east of the state beach in the area of Great Flat Pond ,
and shall consist of approximately o A, , and shall have an ocean
frontage o f approximately 1700 linear feet. "
M,. ,,Kirsner stated that there is no doubt that DEM has the respons
iter to improve Great oak Road, and they should be compelled to do it,
Selectman Hansen stated that the DEM have totally severed their
relationship from Great Oak Road, They have said that those funds
are going to have to come from some palace else; they do not have
the money for that road, and it was not going to be their respons-
ibility* s ns-
ibilit r.
, Kirs er stated that, he believed that, at a prior meeting, he
had expressed the fact that the state was willing to put up the
$100 ,000; the state was willing to put into escrow the $200 ,000.
The Memorandum of Understanding confirms the fact that DEM has
unconditionally agreed to taut up the $100 . 00 and to put u the
$200 ,000. M. Kirsner had indicated that it did not reflect what
the selectmen and the committee wanted; that is, it does not state
that the first $100 ,000, that $50 ,000 was to be reimbursed to the
town.
Selectman Lawrence stated that there were se neral issues similar
to the Kennedy is sue, that crosses their property, P. Lawrence 's
feeling was that all of those issues should be dealt with at one
t i rye.
At the April 24 meeting of the Selectmen, members of the Board
had voted to instruct the South Cape Beach State Park Advisory
Committee to end any and all discussions with the Commonwealth
concerning South Cape Beach until the road surface of Red Brook
Road was repaired to the satisfaction of the Board of Selectmen,
i
