• BIRD of SELECTMEN Page w MINUTES TUESDAY, OCTOBER 1 , 1991 Access to Town counsel : Mr. Harrington is concerned that we are not adhering to the policy that was adopted last year. Selectman Lawrence noted that access to Town counsel should go through Kevin Harrington or the Chairman of -the Board of Select- men. Town counsel was directed not to take calls unless approved y Mr. Harrington or Mrs . Jacobson. Selectman Lawrence would like to obtain a list of the Board of Selectmen members who have called Town counsel and the reason for the call * our decision was plain he - states . This was never clear to ane states selectman cafyn. I was never told by Mr. Reardon or carol or Kevin Harrington. In order to pay Mr . Reardon this amount of money states Selectman Lawrence, I would life to see a complete breakdown of whoa,when and what it was about. Mr. Harrington noted. e has July ' s itemized hill for review. Selectman caffyn asks what the budgeted amount is . The approxima- tion for Legal. -and Engineering Fees is $140,000 informs Mr. Har- rington. With concerns of the Department Heads states selectman Jacob= son, this does not include the regular meetings of Town counsel . The bills are itemized in a general sense informs counsel . There could of been a multiple of matters that would be detailed on the bili, as various Town matters . Selectman Jacobson suggests to place this as an agenda item on October 28 , 1991 . Recall Procedure e; ' Status of Lawrence and Be wa . : Selectman Hanson asks of the status of Mr. Lawrence and Mr. Benway on the recall procedure? He has not received any infor- mation relative to their status . The Town Clerk has made the determination not to recall the above since their term is within six months states selectman Jacobson* Town counsel concurs . The recall election proposal for Mr. Benway and Mr . Lawrence can ' t be held since it is within six months of their term of office. The 1tter from the Town Clerk doesn ' t indicate six months states selectman caffyn. She asks counsel if his interpretation is that n6 one can be recalled if there was no more than six months to their term of office Counsel indicated that it is improper to render an opinion , when. the decision is upon the Town clerk. The Town clerk was firm and clear that she did not need his assistance in this matter. Town counsel notes he has not discused this issue with anyone else in Town other than colleges in a .legal discussion of similar problems . Attorney Reardon indicates he would conclude with Mrs . Labute and the Office of the Secretary of State that i . the election is scheduled to be held within six months of the termination of office of their term, you will not be able to do so. This is noted in Section 1 of the Recall statute.
