k BARB of SELECTMEN Page MINUTES TUESDAY, OCTOBER 15, 11991 Recall Procedure re : Status of Lawrence and Benway. Selectman Jacobson asks if the May election would be consider- ed a recall election? Town counsel indicates no it does not . The process then doesn ' t tale into consideration of what the people want states Selectman Jacobson. Selectman Caffyn indicates that if in fact the petition action is taken by the Town Clerk, it should he qualified upfront# so no one proceeds with the recall action. There was clot of time and effort put into this with three different series of 1200 signatures . Mrs. La ute should have placed he conclusion in writing suggests Selectman caffyn. Perhaps we should schedule an election on January 4, 1992 if there is any dispute to this . The action has proceeded in a democratic process. If she followed the same procedure as my recall states Selectman -Hanson, it would be the day following the deadline for response. Tomorrow would be her response date to the Board of Selectmen. I,f any . action is to be taken place, he would assume it would be one week from now. Town counsel indicates he does not have it in writing from Mrs. Lahute, but she has ruled the recall election of Lawrence and Bnway cannot be held within six months of their term.
