` BOARD OF SELECTMEN Page <br /> MINUTES TUESDAY, OCTOBER <br /> 1 , X991 <br /> Reconsideration of Recall Election : <br /> Mrs , Greelish notes that public statements made are often <br /> not true in the legality sense . The interpretation of the notif- <br /> ication is to go ahead with the recall . . <br /> Selectman Jacobson notes the notification is for the recall <br /> of Willard Hanson. The Board was notified that Mr , Benway and <br /> Selectman Lawrence did not resign. We haven ' t been notified by <br /> the Town clerk that it is our responsibility to sot a date . <br /> The notice from the Town clerk gives a clarification of days <br /> informs Selectman caffyn. The notice of recall date is October <br /> 12th and the first business day is today, October 15th. <br /> It says the Town clerk shall give notice in writing to the <br /> Board of Selectmen no later than one work day following the <br /> expiration of the f.oregoing five days informs Selectman caffyn. <br /> In our bylaws , this notification is to be stated to us from the <br /> Town clerk. The Selectmen then shall order a special election. <br /> The October 12th is the notification. <br /> The Town Clerk ' s notice to Selectman Manson is quite distinct <br /> and different states Counsel . The fifth day is October 12th being <br /> a Saturday. The 13th is Sunday and the 14th is a holiday so the <br /> next business day is October 15th. I asked her specifically if <br /> she had ruled on it and she s4i.d yes . <br /> Selectman Jacobson has accepted the fact that Mrs . Labute <br /> has ruled this way. She notes in Section 1 of Article 2 it reads <br /> that any holder of an elected office of more than six months <br /> may be recalled . And removed states Mrs . Greelish. There are <br /> two steps . With less than six months , they may not . Selectman <br /> Jacobson asks when the clock starts? <br /> The time clod starts with the election date itself informs <br /> Counsel , <br /> The purpose of the recall was to avoid the expense to the <br /> Town informs Selectman Hanson. Within a six month time frame <br /> it would be brouht ' in with the next election. <br /> This would be the same day as the recall states Selectman <br /> caffyn. There would be no added cost . <br /> Mrs . Greelish noted the papers were stamped with a date and <br /> ti-rye to begin some .type of clock running. <br /> Proper notification is here from the Town Clerk states Select- <br /> man caffyn. The signature date is September 17th. We have had <br /> no clear interpretation. There is nothing in writing. She motes <br /> she did not read the article in the newspaper of Mrs . Labute ' s <br /> decision. This is a very important issue to the community and <br /> important to the voters . <br /> Selectman Manson agrees . It is extremely confusing. This <br /> is the first time this has ever happened in the community. <br /> According to section three of the Town bylaw ,informs Select- <br /> man Jacobson, if the office to whoa notice is directed by the <br /> Town Clerk doesn ' t resign within five days, the Town Clerk notifys <br /> the Board of Selectmen. Notice in writing is to be .received not <br /> later than one work day which is this date . The notification <br /> that they did not resign is here. <br /> L_ <br />
