BOARD OF SELECTMEN Page 5 MINUTES • MONDAY, DECEMBER 23, 1991 _ Discussion relative to Shellfish Constable Vacancy : ***The motion was made by Selectman Mills to grant an exemption to the 95% spending cap in the Shellfish Department due to the extensive circumstances of the department . The motion was seconded by Selectman Caffyn. The vote is favorable 3-1 . Selectman Vaccaro is in opposition. Selectman Vaccaro notes this is a dangerous precedent. If accepted now, it clearly will not work and we will pay for this at Town Meeting in May. He has recommended to cut 4 hours per week over 20 weeks to stay within the 95% spending cap. It was noted by Selectman Caffyn the schedule of 15 weeks for 14 hours per week at $12 . 37 and 10 weeks at 40 hours per week will derive at the sum of $7 , 545 . 70. She notes this department is an exception since it has been cut very badly. The Board will vote to appoint David Ryan on Monday, December 30th since it is not a specific agenda item. Attorney Reardon would like the understanding to be clear to Mr. Ryan that this is an interim appointment. The statute requires a three year appointment to this. department . At that time, the Board will consider the application of Mr. Besse for Harbormaster/Shellfish Warden . Appointment of Deputy Shellfish Constables : . ***The motion was made by Selectman Vaccaro to appoint Vernon Thomas , Danny Bohnenberger, Ed Baker and Bob Courtemarche as Shellfish Deputy Constables through June 30, 1992 . The motion was seconded by Selectman Caffyn. The vote of the Board is unanimous . The vote is 4-0 . It was recommended by the Board to submit Mr. Besse ' s application to the Shellfish Commission. 8 : 35 p.m. Policy 90-010: Town Counsel recommends the Board amend the document adopted by the Board on December 16 , 1991 since it conflicts with the policy the Board adopted on September 30, 1991 . The numbering system should indicate the year the policy was adopted. The correct policy number should be 91-010 informs Counsel . ***The motion was made by Selectman Caffyn to amend the document to conform with the vote taken by the Board on September 30, 1991 with the added clause to be included that emergency meetings are an exception in the Policy Supporting Individual Members Rights to Fully Practice Their Religious Beliefs. The motion was seconded by Selectman Mills . The vote of the Board is unanimous. The vote is 4-0 . Memorandum of Understanding: Selectman Caffyn made note of a letter dated December 17 , 1991 to Kevin Harrington of the $1000 per week Sergeant Bevacqua is receiving. • She informs the Board his fixed salary is $700 per week and should be clarified . Attorney Reardon notes his concern of his $300 per week overtime going towards this investigation. If he is assigned to this and not doing his shift on the weekend , extra money is needed for additional help in his absence.
