BOARD OF SELECTMEN Page 5 <br /> MINUTES <br /> • MONDAY, DECEMBER 23, 1991 _ <br /> Discussion relative to Shellfish Constable Vacancy : <br /> ***The motion was made by Selectman Mills to grant an exemption to <br /> the 95% spending cap in the Shellfish Department due to the extensive <br /> circumstances of the department . The motion was seconded by Selectman <br /> Caffyn. The vote is favorable 3-1 . Selectman Vaccaro is in opposition. <br /> Selectman Vaccaro notes this is a dangerous precedent. If accepted <br /> now, it clearly will not work and we will pay for this at Town Meeting <br /> in May. He has recommended to cut 4 hours per week over 20 weeks to <br /> stay within the 95% spending cap. <br /> It was noted by Selectman Caffyn the schedule of 15 weeks for 14 <br /> hours per week at $12 . 37 and 10 weeks at 40 hours per week will derive <br /> at the sum of $7 , 545 . 70. She notes this department is an exception <br /> since it has been cut very badly. <br /> The Board will vote to appoint David Ryan on Monday, December 30th <br /> since it is not a specific agenda item. Attorney Reardon would like <br /> the understanding to be clear to Mr. Ryan that this is an interim <br /> appointment. The statute requires a three year appointment to this. <br /> department . At that time, the Board will consider the application <br /> of Mr. Besse for Harbormaster/Shellfish Warden . <br /> Appointment of Deputy Shellfish Constables : <br /> . ***The motion was made by Selectman Vaccaro to appoint Vernon Thomas , <br /> Danny Bohnenberger, Ed Baker and Bob Courtemarche as Shellfish Deputy <br /> Constables through June 30, 1992 . The motion was seconded by Selectman <br /> Caffyn. The vote of the Board is unanimous . The vote is 4-0 . <br /> It was recommended by the Board to submit Mr. Besse ' s application <br /> to the Shellfish Commission. <br /> 8 : 35 p.m. <br /> Policy 90-010: <br /> Town Counsel recommends the Board amend the document adopted by <br /> the Board on December 16 , 1991 since it conflicts with the policy the <br /> Board adopted on September 30, 1991 . <br /> The numbering system should indicate the year the policy was <br /> adopted. The correct policy number should be 91-010 informs Counsel . <br /> ***The motion was made by Selectman Caffyn to amend the document <br /> to conform with the vote taken by the Board on September 30, 1991 <br /> with the added clause to be included that emergency meetings are an <br /> exception in the Policy Supporting Individual Members Rights to Fully <br /> Practice Their Religious Beliefs. The motion was seconded by Selectman <br /> Mills . The vote of the Board is unanimous. The vote is 4-0 . <br /> Memorandum of Understanding: <br /> Selectman Caffyn made note of a letter dated December 17 , 1991 to <br /> Kevin Harrington of the $1000 per week Sergeant Bevacqua is receiving. <br /> • She informs the Board his fixed salary is $700 per week and should be <br /> clarified . <br /> Attorney Reardon notes his concern of his $300 per week overtime <br /> going towards this investigation. If he is assigned to this and not <br /> doing his shift on the weekend , extra money is needed for additional <br /> help in his absence. <br />
