BOARD OF SELECTMEN Page 2 <br /> MINUTES <br /> MONDAY, JANUARY. 1993 <br /> PUBLIC DISCUSSION: <br /> Mr. Harrington indicated that it is not in the bylaws of <br /> Save the Bay to sign for indemnification, Save the Bay is a non- <br /> profit organization. He asks the Board to request Town Counsel <br /> to reassess the situation. Mrs Harrington doted that work must <br /> be completed by February 15 , 1993 & <br /> The Town is applying for a permit to work on private <br /> property indicated Selectman Costa. If the Spit was Town- owned, <br /> there would be no problem. If the contractor does something <br /> wrong, the taxpayer has: foot the bill 'Informed Selectman <br /> Costa . <br /> For better or fo,r worse, this is a. Town waterway relate <br /> Greg Smith, President of Savehe Bay. He made rote of a mento <br /> submitted by the Harbormaster dated January 5 , 1993 regarding <br /> this concern. The opinion of Mr. Madden indicates that a <br /> significant health hazard will be created if this problem is not <br /> resolved, A potentially dangerous situation will arise. The <br /> water quality will diminish. This will create liability to the <br /> Town- for failure to help us informed Mr. Smith* <br /> Selectman Millsindicated that it would be very <br /> irresponsible of the Board to go contrary to the advice of Town <br /> r Counsel .
