BOARD OF SELECTMEN Page <br />MINUTES <br />MTDA , MAY l . 1993 <br />Citizens for the Protection of Waq2oit_Bay re: Conservation <br />Restriction Pro ram <br />Mr. LeBaron indicated that the Citizens for the Protection <br />of Waquoit Bay cP is a non-profit watershed association in <br />Mashpee and Falmouth educating homeowners on appropriate lanes use <br />and water equality. CP TB also promotes open space acquisitions <br />and cooperates with the Wa quoit Bay National Estuarine Research <br />Reserve noted Mr. -LeBaron, <br />In 1990, CP B met with Mash ee's conservation commission to <br />encourage the use of conservation restrictions informed <br />Mr. LeBaron. *Moni Ferriday of the conservation Commission <br />indicated that the conservation Commission supports the <br />conservation restriction program whole heartily. <br />Mr. Robinson indicated that eleven cape towns have adopted <br />the Compact's "Model conservation Restriction Program." The <br />Compact is a regional alliance of local non-profit groups across <br />the Cape informed Mr. Robinson-* <br />The' Board of Selectmen are the approving authority to record <br />conservation restrictions indicated Mr. Robinson, Ea h <br />conservation restriction is recorded in'the Registry of Deeds. <br />If the restriction is removed, a penalty will be assessed to the <br />land owner related Mr. Robinson. <br />Mr. Robinson indicated that each participating town adopts <br />its own set of guidelines and policies. There is no minimal <br />parcel size. The document will be made clear as to the types of <br />public access existing on a conservation restricted parcel of <br />land noted r* Robinson. <br />Mr. Robinson indicated that a.x reduction is applicable to <br />the owner of the conservation restriction parcel of - land, The <br />lard owner retains title to the property and the rights to use it <br />in ways, which will not harm the environmental values of the land <br />noted Mr. Robinson. <br />The community benefits by protecting important lands at <br />little or no cost informed Mr. Robinson. The restriction can be <br />negotiated to meet the reeds of both the land owner and <br />governmental agency. <br />*The Board is in agreement to take the discussion of <br />Conservation Restriction under advisement at this time. The <br />Conservation Commission, Planning Board and Board of Assessors <br />will be requested to review the proposal. *The conservation <br />Restriction Program will be placed on a future agenda of the <br />Board* <br />
