SELECTMEN' S MINUTES <br /> October 2 , 1979 <br /> Page <br /> assist in this safety factor, what will happen to the septic <br /> systems , fire containment, water suppler, etc. in the new de- <br /> velopment that New. eabu y plans such ;as The villages , Tide <br /> Run, Teal Harbor, Little Neck Bay, Muse Apartments, Maushop <br /> Village oo condominiums) plu ,,- o aoreas that -were just <br /> purchased from Whitcomb by the New Seabury Corp. alone the <br /> Mashee River. <br /> Selectman Benway felt that two issues were being confused. <br /> He explains that the Town of Mashpee went to court fo rt years <br /> ago on the zoning question and the future number of villages <br /> and density Dlanned claiming the New Seabury Corp. permits <br /> were not effective as the. -time limit to construct has expired. <br /> The legal process : Superior Court, Appeals Court, and the <br /> Supreme Court determined the original zoning New Seabury had <br /> in 1962 authorizing 1.700 units is applicable. Any future <br /> plans for SC.B will go before the Town for approval. <br /> Mr, Sloane asked Mr. Benway to include Great River and wa- <br /> quoit Bay in this discussion as SCB has an impact on those <br /> areas also. <br /> Mr. Benway said that as of yesterday (10/23) , the ACEC des- <br /> ignation includes all of 'aquoit -Bay, SCB, Jehu Pond, Wash- <br /> burn Island and excludes Monomoscoy Islands , one-half of <br /> Great River and ' econse tt Island. The Board' s maim concern <br /> is to maintain a deep- water access from Waquoit Bay to Nan- <br /> tucket Sound as Mashpee is the only Town without such an <br /> access, or, docking facilities . It would not be feasible to <br /> use Popponesset Bay for docking purposes as it has a severe <br /> shoaling problem, Acquiring State funds to improve this <br /> barrier beach has not been successful. The only avenue open <br /> to restore the barrier beach may be to truck in compatable <br /> sand and plant grass. We must remember that the same laws <br /> which apply to Poppone s s e t Bay apply to Waco uoi t Bay i e. "Wet- <br /> lands Act, Title V" , Septage, Conservation, etc. The ACEC <br /> language is very broad and the more CZM works on the ACEC <br /> language, the more exclusions there are, it defeats the pur- <br /> pose of the designation, The area can be protected by local <br /> zoning and by-laws . <br /> At this point, Selectman Garland reviewed and described to <br /> those present a map of sB prepared by the State in 1974 <br /> which outlines proposed uses. As he pointed to Jehu Pond he <br /> noted that this pond is stagnated and if something is not <br /> done (this would require new dredging) , the pond will become <br /> a cranberry bog. He supported Mt. Benway' s remark that ef- <br /> forts over the past' several gears to acquire state funds for <br /> dredging, and placing .a 14 ' culvert at Monomoscoy have been <br /> denied. <br />
