1 <br /> Page 3 <br /> Board of Selectmen <br /> Minutes <br /> September 13, 1994 <br /> Discussion re: Mobile Home Parks Rent Control Petition: <br /> Rent control can be established in conununities with a population of <br /> less than 50,000 through special legislation indicated Selectman Mills. <br /> Thisprocess is generally adnministered through rent board r <br /> municipal agency. <br /> Using the Forth Reading legislation as a model, the rent board's <br /> actions are subject to the provisions of the state's Administrative <br /> Procedure Act indicated Mr. whritenour. Therefore,decisions of the <br /> rent hoard concerning rent adjustments and approval or denial of <br /> eviction applications are subject to judicial review, <br /> Linder the Forth Reading legislation, the Board of Selectmen issue a <br /> discontinuance permit indicated 11r. writenour. The discontinuance <br /> process includes a public hearing by the rent board which then issues <br /> a recommended action to the Board of Selectmen. <br /> The Forth Reacting legislation which the Lakeside Trailer Park <br /> Homeowners Association has used as its model is one of supervision <br /> and regulation of the rental of space by private landowners in mobile <br /> home parks related lir. whritenour. <br /> In Town Counsel's opinion, the petition article as submitted by <br /> the Lakeside Trailer Park Homeowners Association for the 1994 <br /> October Annual Torn Meeting Warrant is considered flawed <br /> indicated Selectmen Mills. <br /> The petition article as presented will appear on the October Town <br /> Meeting warrant indicated Selectman Mills. If the article passes, <br /> it wiU be turned down by the Attorney General. The Attorney General <br /> reviews the actions of Town Meeting for legality poses noted <br /> Selectman Mills. The wording of the article as presented is not <br /> legal. <br /> Selectman Mills suggested the petitioners prepare a second article <br /> for the 1995 May Annual Town Meeting for presentation of the <br /> article in proper form. <br /> Mr. Benjamin Aldrich,President of the Lakeside Trailer Park <br /> Homeowners Association discussed his memo of August 2.2., 1994 <br /> with the Board. <br /> As noted by Mr. Aldrich, rent has increased from $114.00 per <br /> month to $178.00 per month as of August 1, 1994. <br />
