Stone showed up at the meeting with nothing prepared to offer. Peter said, as he understood it, the next meeting, in 2 weeks, will be to see if we can agree with the CPM and is it reasonable enough to meet the opening . date. Paul said it is that and to hopefully see some good faith progress on the job. Also to see if Stone can stick to the CPM. The bonding company did warn Stone to meet the schedule they deliver. Joe asked if nothing to dates counts, its only going forward? Paul said no, we have enough documentation to hold our ground. There is still a tremendous risk to get rid of Stone completely. It is in our best interest to have Stone see the light and turn the job around. Peter said the bond counsel gave advice to Stone - don' t make promises you can't keep. There is no trust and he thinks Liberty understands that now. Paul agreed we have no faith in Stone . We don't believe what they say and we don' t believe they can finish the job on time. At what point do we develop an implement a contingency plan because we don't think they are going to make it. Paul is also concerned about how these defect issues will get resolved. Steve said even at the last meeting, the manpower loading figure was unreasonable and now it is 3 weeks later. Paul said that was discussed at the meeting. Stone says they have calculated 80 men per day is enough to finish and they have that. Steve said the School Committee does not have much time left to make decisions . Janice said the School Committee is counting on this Committee to tell them the building is not going to be done on time. Paul said he thinks the academia wing can get finished. The one component he does not know is the time required to fix the deficiency list . Steve said if we take partial occupancy with this contractor, with this history, it would be suicide . We have to, for the School Committee, set a drop dead date . Peter asked, if the school opens late, what are the options - trailers , double sessions? Janice said double sessions are not an option/possibility. John Williams said the 990 instructional hours must be met, no waiver will be granted. Janice said the School Committee will keep the 7 , 8 & 9th grades together. They can probably be squeezed for a few weeks . Paul said there are liquidated damages in the contract. They should look at what is in the best interest of the students . This will be discussed at Wednesday' s school committee meeting . Joe asked if Stone is broke . Jim does not think money - solvency of the company - is an issue . Bill wants to set a deadline, so everyone knows where we are going. Paul said it is not that easy. You don't want to make problems worse. 2
