Joe said it wouldn't be so bad if the quality of work was going well and
they were behind schedule but that is not the case.
Peter said we have the technical and legal right to terminate the contract
now.
Paul said we have to be careful if the bonding company is not on our side .
Steve said when push comes to shove, Stone will try everything they can -
no question. How long do we put up with this before we pull the plug?
There is a major problem with letting this run out, the value of the
original work we paid for is going down.
Paul said you take it out of the next months draw.
He said the next 2 weeks will be very interesting. He does not know what
the outcome will be then. It is very frustrating to him that this can't
get resolved. You could not get the vote (to proceed with terminating
contract) from the Selectmen now.
Ian agreed it is very important to get the bonding company to understand
the problem from our perspective.
Paul said Liberty told us they could play hard ball for 60 days before
taking over.
Merry Sue said the bonding company has to come to the same conclusions we
have about Stone and we have to wait it out until then.
Paul said he believed Liberty would have come to the meeting prepared and
knowledgeable but they were not. By the end of the meeting he thinks
Liberty was beginning to see where we were coming from. If
the defects are resolved and there are more men on the job, maybe .
Steve thinks we should set a decision date.
Paul said at last weeks meeting is was him against everyone else . If
Liberty does not see us as a victim we could loose March and April and have
no chance to get the job done. If we terminate the contract, we want
Liberty to pick the best option - in our best interest .
Steve said it is strictly money to them, the cost to do the job.
Stone just wants to drag out the process so they can continue to get other
jobs going.
Janice asked to hear the opinions of Joel , Tom and Jim.
Joel believes the process that came out of Fridays meeting is the right
one. There is a benefit to have the 2 week period to give the bond company
time to see what is going on.
The larger picture, can they finish the job on time? How far behind
schedule are they? Joel believes they are 3--8 weeks behind. They can not
finish if they continue this course . Something has to occur differently
from how they are operating now.
Peter asked if a competent firm would have time to complete segments C & D
(gym and auditorium) in this time frame?
Joel said yes they could, in 5 months. The gym is not a major part of the
work. The auditorium has a lot of finish work as does the kitchen. There
should be no reason to go in and work, as needed, to finish it.
