Draft 3 <br /> 31512014 <br /> submitted as an emergency article, based on recommended language provided <br /> by the Massachusetts Division of Conservation & Recreation. <br /> Article 16 <br /> To see if the Town will vote to amend Article V of the General Bylaws by deleting <br /> §3-21 in its entirety. <br /> Submitted by the Board of Selectmen <br /> Explanation: Massachusetts General Law Chapter 60, §77B allows the <br /> custodian of tax possessions (Treasurer) to sell tax foreclosed properties at <br /> public auction. Section 3-21 restricts the disposition or sale of tax foreclosed <br /> property until Town Meeting action is taken, restricting our ability to restore <br /> properties to the tax rolls. <br /> Article 17 <br /> To see if the Town will amend the General Bylaws by incorporating the following <br /> sections requiring that all members of appointed and elected multi-member <br /> bodies of the Town be residents of Mashpee, and to revise the succeeding <br /> section references appearing in each respective Chapter of the General Bylaws <br /> to reflect the incorporation of the new sections: <br /> 1) Chapter 3, Article I Miscellaneous Provisions: Add a new §3-1 as <br /> follows: <br /> §3-1 Residency Qualification: <br /> All appointees to multi-member boards, commissions or committees of the Town <br /> must be Mashpee residents as of the date of their appointment and throughout <br /> their terms of office; provided, however, that Town officers or employees <br /> designated to serve "ex officio" by virtue of their office on any such board, <br /> commission or committee shall be exempt from this requirement,. and provided, <br /> further, that non-resident appointees to multi-member boards, commissions or <br /> committees holding Town office or employment positions as of the effective date <br /> of this amended Bylaw shall be exempt from this requirement for the remainder <br /> of their terms of office or employment. The office of any appointee to which this <br /> residency qualification applies shall be deemed to have been vacated upon <br /> removal of the appointee from the Town. <br /> 2) Chapter 4, Article I shall be re-titled "Miscellaneous Provisions" with a <br /> new §4-1 appearing as follows. The Current Article I — Board of <br /> Selectman shall be re-codified as Article II, with each successive <br /> Article and section re-codified in sequence. <br />
