to the hospital. Due to her health, she did not return to the unit and subsequently sold it to the <br /> owner of Otis Trailer Village, Dr. MacDonald. Dr. MacDonald was in the process of cleaning the <br /> unit, and has been instructed to contact the Health Department for a re-inspection to determine <br /> if it meets habitation standards and if the condemnation can be rescinded. Mr. Harrington stated <br /> that, at this point,the Board would need to issue the formal condemnation. <br /> There being no further discussion or questions, laurel Almquist made a Motion to condemn the <br /> dwelling at 1S MacMurphy Drive based on the July 30, 2018 Sanitary Code inspection. Motion <br /> seconded by Brian Baumgaertel. VOTE: Unanimous (2-0). <br /> 6. Noise Violation: 96 Cayuga Avenue. <br /> Mr. Harrington stated that no one was present to represent 96 Cayuga Avenue. He advised the <br /> Board that, at the end of last year and again in the spring of this year, several noise complaints <br /> had been registered with the Animal Control Officer regarding roosters at 96 Cayuga Avenue. Due <br /> to the complaints, the Animal Control Officer required the removal of the roosters. On June 4th, <br /> the Board of Health sent a letter ordering the removal of the roosters. On July 7th, the owner <br /> requested a hearing to reply to the order to remove the roosters. The hearing was set for the <br /> September 13th meeting; however, the Animal Control Officer emailed Mr. Harrington on <br /> September 101h indicating that the roosters had been removed from the property. Written and <br /> signed statements and emails from three of the neighbors of 96 Cayuga Avenue were received by <br /> Animal Control and the Board of Health regarding the noise. <br /> In August and early September, additional complaints were received concerning the screeching <br /> of an animal at all hours of the day, but mainly at night. It was later determined that there were <br /> quails on the property at 96 Cayuga Avenue, The Animal Control Officer was on the property on <br /> September 7th, and spoke with the owner who admitted the male quails were screeching due to <br /> a neighborhood cat in the area of the quail pen. One of the neighbors recorded sound bits of the <br /> male quails at 11:30 at night. Mr. Harrington stated that the noise is not loud, but would certainly <br /> meet the criteria for violation of the noise by-law, as it is after 10 pm and before 7 a.m. <br /> Mr. Harrington believed, with the admission by the owner regarding the quails and the sound <br /> video that was recorded at 11:30 p.m. by a neighbor, an order to remove the male quails was <br /> justified. <br /> There being no further discussion or questions, Laurel Almquist made a motion to order the <br /> removal of the male quails at 96 Cayuga Avenue, due to the sound video recorded by a neighbor <br /> at 11:30 p.m. and the admission by the owner that it was the male quails doing the screeching. <br /> Motion seconded by Brian Baumgaertel. VOTE: Unanimous (2-0). <br /> 7. Request for Food Establishment Permit: Love and Light Nourishing Foods, LLC,439 Nathan Ellis <br /> Highway. Mr. Harrington stated that a request had been submitted by Mary Galvin of Love and <br /> Light Nourishing f=oods to operate a food establishment called'BeReal Food" at the same location <br /> where White Lion Baking Company operates. They are planning on sharing space for the <br /> production of their new line of foods. Mrs. Galvin is currently working from a residential kitchen <br /> in Yarmouthport. The ServeSafe, menu,and allergy awareness certificates were provided. White <br /> Lion Baking is already a licensed establishment, and no changes are being requested to the <br /> equipment or floor plan. The fee has been paid.
