food establishment permit with the condition that an inspection be conducted by a Health Agent <br /> prior to operation. <br /> Paul Galvin, Mary Gavlin's husband, introduced himself and indicated that he helps with the <br /> business end of things. He gave some background on the company, explaining that the product <br /> (cookie dough) does not require refrigeration and a patent is currently pending. In order to sell <br /> the product outside of the state and, because of the nature of the product, it has to be produced <br /> out of a gluten-free commercial kitchen. Mr. Galvin stated that, two Sundays a month when <br /> White Lion is closed for business, Mrs. Galvin will be using their facility to make the dough that <br /> will be sold outside of Massachusetts. She will not be baking or cooking anything at White Lion, <br /> and she will continue to prepare dough in her residential kitchen for sale within the state. <br /> Mr. Harrington requested a meeting with Mrs. Galvin at the White Lion facility, where she could <br /> walk one of the Health Agents through the process of preparing and packaging the dough. <br /> There being no further discussion or questions, Laurel Almquist made a motion to approve the <br /> Food Establishment Permit for Love and Light Nourishing Foods, dba BeReal Food, with the <br /> condition that an inspection be conducted by a Health Agent prior to operation. Motion seconded <br /> by Brian Baumgaertel. VOTE: Unanimous (2-O). <br /> 8. Request for Outdoor Seating. The Chocolate Rose, 628 Main Street, Suite A. Mr. Harrington <br /> stated that a request had been submitted by Vanessa Benoit of The Chocolate Rose to amend <br /> their Food Establishment permit to include 12 outdoor seats. Due to the restriction of the well <br /> on the property,the public is not allowed to use the bathrooms, or the well would be considered <br /> a transient, non-community well, which it cannot be. The on-site well does not have its entire <br /> protective radius of 100'on the property,therefore it can never be considered a permitted public <br /> well. This was discussed at the permitting of the food establishment, where the Board ordered <br /> the use of bottled water for preparation of all consumed foods. Mr. Harrington stated that a <br /> letter dated November 1, 1989 from Larry Dayian, Section Chief of the Drinking Water Section of <br /> DEP, is the source of the guidance being used in this case. That letter states that if a take-out food <br /> service establishment uses bottled water and the public cannot access the restrooms served by <br /> the well, then the facility is under local Board of Health jurisdiction. Mr. Harrington explained <br /> that the Chocolate Rose was requesting approval to place a portable toilet on the property for <br /> customers who are there using the seating. <br /> Vanessa Benoit, owner of The Chocolate Rose, introduced herself and stated that the lack of <br /> seating is negatively impacting their business. She stated that seating would be strictly weather <br /> permitting. Mrs. Benoit also indicated that she spoke with Andy Marks from the Water District <br /> and the Building Commissioner who both agreed that,by using the portable toilets,The Chocolate <br /> Rose was complying with any restriction relative to the water. Mr. Harrington indicated that he <br /> had never seen Mr. Mark's comments on the matter. He further stated that the property owner, <br /> P.A. Landers, has no intention of bringing Town water onto the property. <br /> Mr. Harrington reminded the Board that there was no rush to make a decision, as the proposed <br /> seating would not be in place until next year; however, Mrs. Benoit indicated that she would like <br /> to begin offering seating this year, if possible, as it would help them to assess its impact on <br /> business and to determine whether they will remain at that location. <br /> 5 <br />
