Tcrrie MeDbnald stated there have been reports of box turtles in front of S vane s Path and <br /> said that Willo vbend needed to mitigate land because of the presence of box turtles. She <br /> expressed concerns that the construction will be disturbing to the turtles' habitat(rare species <br /> habitat). The Agent noted that if Natural Heritage has jurisdiction in this area, they receive <br /> a copy ofthe Notice of Intent, the project plan, and the narratives. Natural Heritage ill <br /> make a decision as to whether or not it will be considered a `take' f an endangered species. <br /> If Natural Heritage determines a 'no take' status then the project can move forward, but if <br /> it is determined that it will result in a prohibited `take', then the Applicant will have to <br /> address that issue. The Agent said Natural Heritage has 21 days to s ubmit its continent letter. <br /> He said that the permit will be issued afterthe Conservation Department receives the letter <br /> from Natural Heritage. <br /> Terrie McDonald stated she was also concerned about the use of Savannas Path for <br /> construction and asked if there will be any restrictions as to when`the trucks will come <br /> through. The Agent informed her that the Conservation Co=ission does not have <br /> jurisdiction because the construction access is outside of the 100-foot setback. Mr. Vaccaro <br /> made clear that the intention is to use the Sampson Road access im'tially to build out the <br /> construction road to route 2 , and then to shift the access to the north side. <br /> Motion: Mr. Shaw made a motion to close and Tissue, seconded by Mr~. Sweet. Vote <br /> unanimous 6-0., <br /> 6:21 Kenneth and Gloria J. Liatsos, 118 Shore Drive West.
