He stated that <br /> qP <br /> it was his opinion that the Town had the right to exercise the option <br /> at any time within the period specified in the December 1990 Agreement, <br /> and that the land transfers contemplated by the terns of the June 1980 <br /> Agreement become operative upn funds being allocated. <br /> George Costa suggested that the Town share lifeguard applications <br /> with the state agency. The Town would share the applicants that <br /> they do not use to fill- the lifeguard' po itions on the State Beacho <br /> N. vont alides stated they would relay that issue to the State. <br /> Maintenance of Great Oak Road: Jack Cramer stated that there had <br /> been some press reports relative to the dart part of the road would <br /> remain dirt. The community thought that the whole road was going <br /> to be paved, but the dirt will remain dirt. Tn reading the manage- <br /> ment plan, it appears that the dirt road will be paged down to the <br /> entrance to the new parking lot. Jack Cramer had spoken with Rep. <br /> ahir throe or four weeks -ago, Tori Cahir stated he was aware of the <br /> problem and was working on taking care of it. <br /> Cramer: The other issue was DPW has been grading and working the <br /> road at their expense because the maintenance costs from the state <br /> have ceased to flow. That is something that will have to continue <br /> to be addressed. It develops that. that part of the road is a State <br /> road and this is being done as an accommodation to the town resi- <br /> dents who have to get to the Town Beach. <br /> M. Kirsner referred to Commissioner Webber's communication of March <br /> 27, 1995 to Morris Kirsner as chairman of the advisory committee <br /> "The issues raised regarding the maintenance of Great Oak Road and <br /> cooperation between facility managers should continue to be discussed. <br /> Nick vont alides, DEI Legal Counsel, will work with you to draft an <br /> agreement between DEM and the Town of Mashpee to address these mat- <br /> ters, " <br /> a.t- <br /> ters. " ' <br /> Nick agreed, if there were secondary issues that arise, he had been <br /> designated to work as liaison to' the committee. M, Kirsner asked <br /> Nick to draft a memorandum to the committee- to that effect, and the <br /> committee will review it. <br /> ITEM #49 : There- was a situation where they referred to the presence <br /> of dogs and horses on the beach. M. Kirsner called to their attention <br /> the Mashpee Bir-Law which prohibits dogs and horses on the beach. <br /> Therefore, that provision has been eliminated from the plan. <br /> Issue #67 : The role of the advisory committee: As set forth in detail <br /> in the June 1981 Agreement, "An amendment of an agreement cannot <br /> modify or limit the role of the advisory committee. The committee <br /> ha responsibilities as set forty by DEM. " <br /> i <br />
