oil SOUTH CAPE BEACH APRIL 30 , 1996 PACE Two Iv DISCUSSION of 10A SITE Mr. Kirsner explained that the 10A site was an absolute obligation of -DEM. This obligation will not be affected if- the town should elect not to_. take the town beach. - Nor. Kirsner further explained-::-that he had not discu sed this matter with N. vont a lides and indicated that the committee would place this item on the agenda for the next meeting and pursue the issue. Bill Matiros explained that there have been many ,questions asked ed relative to the use of -the -10A site by .the Town. , Kirsner stated that the use by the town is spelled out very specifically in the Agreement. whether or not that use is compatible with what the town wants, the town has no knowledge. If, in fact, the use as stated is not con-. sistent with what the town would like, Morris understood that DEM would consider an amendment to that particular paragraph to make the use consistent with the wishes of the -- tw . i M. Kirsner explained the f irst thing we have to do is place that issue on the agenda. The second, a have to eater into discussion as to uses. Then, under the provisions of that paragraph, DEM will make their best efforts legislatively so that DEM will be in a position to convey title to that 10A site to the town. If in fact they have done that, and If in fact they do not succeed, then they are obligated to a give the town a 99 year lease for a consideration of $1. 00 per year. That should all flow once we discuss the use. Access for Handicapped - Dead Neck: Bill Martiros explained that in the original agreement, there was planned to be a road and parking for six vehicles. Bill questioned when that was going to materi-alize. Chris Caultexplained that since the time of the agreement, there was a road there. The storms destroyed the road. Bill continued, "when we had our open meetings, there were many people looking for that access." W. Woods explained that it was made clear in the agreement, by permit. C. Gault asked if it was Bill' s understanding that the State had agreed to lay a new road all the war ,down to the park* M. Kirsner explained that it was his understanding that the 10A site would be made available by deed for the specific purpose as stated in the paragraph.
