PAGE TWO <br /> II LEGISLATION: <br /> Nick Vontzalides, on behalf of DEM suggested as a measure of making <br /> some progress on this issue, that there be some conditions attached <br /> to the legislation, such as , the land be used only for passive re- <br /> creation, which had been the intent, restrict it to the extent that <br /> there be no future development, nor construction on the property, <br /> which had never been contemplated. <br /> The purpose of the recommendations of Nick Vontzalides were to re- <br /> duce the land to such a value, in the event of an appraisal, it <br /> would be comparable to land that was under water. It would have <br /> very little value. <br /> Mr. Kirsner then suggested that the board of selectmen write a <br /> letter. A letter was prepared by Joyce Mason, Town Administrator <br /> dated June 16, 2003. <br /> Mr. Kirsner then informed the Chairman of the committee, that the <br /> selectmen had gone as far as they could go. We are not a legislative <br /> body. We had made our recommendations , and we had gone forward <br /> strongly in every particular direction. The bill needs help. We <br /> need some legislative support. <br /> As a result, Chm. Leveille called a meeting on Monday, asking Mr. <br /> Kirsner to be present on June 16th at a meeting with the legisla- <br /> tors of Barnstable County, representatives of DEM, and others to <br /> determine if perhaps we could come to some formal understanding. <br /> Mr. Kirsner explained that they met, and some progress was made. <br /> They went along with what Nick Vontzalides suggested with the <br /> reservation, however, that we would not relinquish, nor waive our <br /> position legally in the event of any appraisal with anything be- <br /> yond reason, and that it would not have to be considered deter- <br /> mined whether it was reasonable, or not reasonable. Mr. Kirsner <br /> was particularly impressed by the fact that one of the conditions <br /> which would have to be met was the question of survey of the pro- <br /> perty, which should be very expensive. <br /> Mr. Kirsner explained further that fundamentally, they came to a <br /> general agreement that DEM, in light of our agreement to use the <br /> land for passive recreation, would join forces. with us to determine <br /> if we can get the bill through. <br /> DEM was represented by Nick Vontzalides , Counsel, and also by <br /> Christine Gault. It was agreed that Ms Gault would be in charge <br /> of ingress and egress to the property, subject to, however, that <br /> Mr. Kirsner was going to appoint a sub-committee from the advisory <br /> committee to work along with Ms. Gault. <br />
