Motion: Mr. Sweet moved to continue the hearing at the request of the applicant to <br />10/25 at 6:03 p.m., seconded by Mr. Smith. Vote unanimous 5-0 <br /> <br /> <br />6:03 Mark A. & Cheryl Rogers, 87 Hooppole Road, After-the-fact NOI to permit <br />stone retaining wall and beach area/beach nourishment and buffer restoration <br />permitted under DEP File #43-2399. Continue from 8/9 – applicant to submit revised <br />plans NOI <br /> <br />Resource Area: Inland Bank, buffer zone to Inland bank and buffer to Land Under <br />Water bodies and Water Ways: Johns Pond <br /> <br />Michael Borselli, Falmouth Engineering, and Peter Hansen, Landscape Designer, were <br />present to represent the applicants. Mr. Borselli stated they updated the plan as discussed <br />at the 8/9 hearing. He reviewed the history of the property and the updated plan so all the <br />information on the old plan was on the new plan. He said they retained Mr. Hansen who is <br />an expert in designing buffer plantings. He said the current revised plans shows the buffer <br />restoration areas and all the specifics and all the lawn areas in accordance with the <br />conservation standards and shows the areas down to the water’s edge with the <br />enhancement of the buffer with native shrubs. He said we have satisfied all of the issues <br />raised. The Agent said he met with Mr. Hansen and Mr. Borselli at the site and he is <br />happy with the species chosen. He recommended a Close and Issue. It was suggested <br />the site be monitored for 5 years instead of the usual 3 years including the trees. <br /> <br />No comment from the public <br /> <br />Motion: Mr. Sweet moved to Close and Issue with the condition that the site is <br />monitored for five years including the trees, seconded by Mr. Dalton. Vote <br />unanimous 5-0 <br /> <br />6:06 Popponesset Beach Association, 0 Uncle Percy’s Road. Proposed <br />construction of shoulder/gutter (walking path and drainage), replacement of swales <br />and installation of 3 park benches. NOI <br /> <br />Resource Areas: LSCSF, BVW, Land Under Waterbodies and Waterways (LUWW), <br />Buffer Zone to BVW and LUWW <br /> <br />Mark Flaherty, Flaherty and Stefanie, Inc. and Brad Holmes, Environmental Consulting <br />and Restoration were present to represent the applicants. Mr. Flaherty explained that <br />Popponesset Beach Association owns property adjacent to Dean’s Pond and they would <br />like to install a 4-foot shoulder gutter to serve as both a walking path and for drainage <br />purposes. The gutter would be comprised of a grass, sod, path with a pea stone gravel <br />strip and check dams for water quality purposes. The existing swales would be replaced <br />with riprap swale. Also, the proposal includes the placement of three park benches on <br />wood platforms. He noted Mr. Holmes performed the wetland delineation of the bordering <br />vegetated wetlands along the edge of Dean’s Pond and stated a silt fence will be placed <br />along the border so there is no loss of wetland. He said the plan is designed to mitigate <br />the impacts to stormwater runoff. <br /> <br />The Agent noted the wetland flags were blown off and it was difficult see the delineation of <br />the wetlands. Mr. Flaherty stated they can put up wooden stakes instead of the flags. He <br /> <br />
