6:00 John W. Walkinshaw & Susan E. Poniatowski, 86 Lakewood Drive Proposed
Amendment of OOC 43-2893 to expand footprint and grading. AOOC

Resource Area: BVW, Inland Bank, Buffer Zone to Inland Bank, Land Under Waterbodies
(Mashpee Pond)

Matt Costa, Cape & Island Engineering, represented the applicant. He explained the existing
Order of Conditions was issued on December 27, 2016. The approval was to raze and replace a
single-family dwelling and deck, rebuild existing stairs and rebuild a portion of retaining wall within
the same footprint, install a temporary dock, and install mitigation plants. They are requesting to
amend the existing Order of Conditions to revise the previously approved house outline and
grading around the house. The proposed changes maintain the approved distances from the
proposed structure to the wetland and will not have any additional impacts to the resource area.
These changes are within the areas of alteration and limit of work area previously approved by the
Commission. The changes do not change the mitigation requirements.

The Agent reviewed the Board of Health comments. The front half of the lot is located in a Zone II
and the leaching facility is located in Zone II and the lot is restricted to three bedrooms and a septic
inspection is required prior to a building permit sign off. He inquired about two trees on the north
side of the lot, an 8” and 19” and asked if they were new removals. Mr. Costa wasn’t sure and he
said if that is the case, the trees being within the 100’ to the top of the bank, he didn’t see any
problem with planting a couple of additional trees. The Agent showed some photos of the property
which showed the area of expansion and where mitigation is proposed. Mr. Costa noted they will
be relocating the fence on the northeasterly side of the property.

No comment from the public

Motion: Mr. Sweet moved the approval the Amended Order of Conditions, seconded by Mr.
Smith. Vote unanimous 4-0

6:03 William Zammer, Jr., Trustee, 6 Beach Road. Proposed Amendment of OOC 43-2936 to
extend retaining wall along northern and western property lines. At request of applicant,
continued from 4/26. AOOC

Resource Area: LSCSF

Matt Costa, Cape & Island Engineering, represented the applicant. He explained the existing
Order of Conditions was issued on November 29, 2017. The approval was to raze and replace the
existing single-family dwelling, a new Title 5 system, rinse station, covered entry, porch, stone drive
and retaining wall along with landscaping. The request is to amend the existing Order of
Conditions to change the previously approved retaining wall and extend it down the northern and
western property lines. He noted the proposed changes are minor and will not have any additional
impact to the resource areas and meets the performance standards. He said the runoff will be
captured in the drywells.

The Agent said this is a minor change and this will be conditioned that the homeowner will be
responsible for any water that is discharged in neighboring properties.

No comments from the public

Motion: Mr. Sweet moved to approve the application for the Amended Order of Conditions,
seconded by Mr. Smith. Vote unanimous 4-0
