No comment from the public

Motion: Mr. Sweet moved to Close and Issue, seconded by Mr. Smith 4-0

6:15 NJCJLLC, 21 Metacomet Road. Proposed pier, ramp, and float. NOI

Resource Area: Land Containing Shellfish, Coastal Bank, Coastal Beach, Land Under
Ocean, Salt Marsh, Salt Pond

Michael Borselli, Falmouth Engineering, represented the applicant. He stated the project consists
of constructing an elevated walkway, a timber pier, ramp and float and will be consistent with other
nearby piers, ramps and floats in the area to allow the applicant access to Great River. There is
also a proposed pile supported lift proposed on the north side of the fixed pier. This will allow for
the boat to be stored when not in use. He illustrated the project on the plan. He noted the
Harbormaster had concerns about navigation in this location because it is one of the narrowest
parts of Great River and couldn’t support a pier of this length at this location. He said he wanted to
work with the Harbormaster and would like to get the Commissioners’ feedback. He pointed out
the project is designed to meet the Army Corps standards. A dock cannot project more than 25%
and their design is 24% because they are trying to balance water depth against navigation. He
said there is a possibility of making the dock shorter and he will meet with the Harbormaster on site
and come up a way to reduce the length. He stated the Shellfish Warden made the observation
the pilings will penetrate the bottom and will eliminate about 10 square feet of shellfish on the
bottom so shortening the dock would eliminate pilings and this may address his concerns. He said
the intention is to have one boat. He asked for feedback from the Commissioners.

The Agent stated the shellfish warden said the impact would be approximately 10 square feet of
shellfish habitat from the piles and the harbormaster has concerns about navigation. He noted he
didn’t see any details of the boat lift on the plan and that needs to be added to the plan. He said
his concern about the boatlift is about the impact of that structure. He noted there was resource
area left out of the plan which is a salt pond. He showed images of the property on the photos
provided.

Following a lengthy discussion regarding the length of the pier and adjustments that can be made,
Mr. Borselli requested on behalf of the applicant a continuance. He said he will come back with
details related to the dock and the boat lift.

No comment from the public

Motion: Mr. Smith moved to continue the hearing at the request of the applicant to June 14,
2018 at 6:03 p.m., seconded by Mr. Sweet. Vote unanimous 4-0

6:18 John D. & Karen Dugan, 15 Aunt James Road. Proposed addition to existing dwelling,
installation of swimming pool, hardscape/landscape modifications. NOI

Resource Areas: Flood Zone, buffer zone to Inland Bank, BVW, Fish Hook Pond

Andrew Garulay, Yarmouthport Design Group, represented the applicants. He stated the proposed
project is to add a swimming pool and expanding their living room. The first floor deck is being
removed to create the room for the pool and patio. They are also proposing to construct wooden
stairs from the first floor to the pool and patio and concrete stairs from the patio to the existing
grade behind the addition. The Arborvitaes are being preserved by a retaining wall. Some of the
