Motion: Mr. Smith moved a Negative Determination with the condition the <br />homeowner work with the Agent regarding the dumping of the debris seconded by <br />Mr. Dalton. Vote unanimous 4-0. <br /> <br />6:06 George & Kathleen Hodgson, 17 Cedar Street. Proposed construction of dock <br />and walkway, mitigation plantings. NOI <br /> <br />Resource Area: Coastal Bank, BVW, Salt Marsh, Land Under Ocean, LSCSF <br /> <br />Wayne Tavares, Wet Tech Land Design, Inc, represented the applicants. He stated the <br />proposed project is to install a dock and elevated wood walkway. New mitigation plantings <br />shall offset the pond and one more fence will be installed to protect the steeper portion of <br />the coastal slope. The mitigation plan will be implemented after construction. The <br />proposal will allow the owner a separate dock with upland access to that dock which will <br />also allow wildlife habitat and fisheries to flourish. The elevated steps will allow access to <br />the dock without stepping on the buffer zone of the coastal bank. They are also requesting <br />to eradicate the poison ivy. Mr. Tavares reviewed the proposal on the plan provided. <br />There will be a bridge over the salt marsh in order for the walkway to extend over <br />Shoestring Bay. The walkway will be 4 wide and 4½ feet wide above the salt marsh to <br />allow for sunlight penetration. He said very little trees will come down. As it’s, built they <br />will work around as many trees as possible. <br /> <br />The Agent reviewed the comments from the Shellfish Constable who had no problem with <br />the dock construction. He noted if approved, Chapter 91 will require side steps for a fixed <br />pier. The Agent show some images and asked about the two pine trees and stated he <br />would prefer they not be removed. Mr. Tavares stated they will work around the trees via <br />the scheduling of an onsite with the agent prior to construction. <br /> <br />Public <br /> <br />Linda, neighbor, stated she was not objecting to the construction but was hoping <br />consideration would be given to the wildlife and their nests. She said in the spring there <br />are swans that come to nest and the area is very rich in wildlife. Mr. Tavares stated he <br />hasn’t seen any nests but they will make sure none of the wildlife is disturb. The Assistant <br />Agent inquired about the extent of the removal of the poison ivy and what they were <br />proposing to remove. Mr. Tavares stated the removal will be at the walkway. The Agent <br />stated conservation would condition to restrict the removal of poison ivy to areas that are <br />commonly traversed for traffic approximately 5 feet back. We don’t want to get into areas <br />that are naturally vegetated that will remain undisturbed. He stated the poison ivy should <br />only be cleared for what is absolutely necessary for health and piece of mind. <br /> <br />Motion: Chad Smith moved to Close and Issue with the condition the applicants <br />work with the Conservation Agent to minimize the impact as well as take direction <br />on removing the poison ivy, seconded by Mr. Dalton.
