<br /> <br />HEARINGS: <br /> <br />6:00 Robert H. Michelson & Alan P. Michelson, 62 Spoondrift Way. Proposed removal, <br />replacement and expansion of a fence and patio. RDA <br /> <br />Resource Area: LSCSF, Buffer Zone to BVW, Salt Marsh, Land Under Ocean <br /> <br />Alan Michelson, homeowner, explained this project includes the removal of a long-rotted partition <br />wall, a falling down rail and post fence that runs along side the north side of the property and add a <br />new stockade fence, replace and extend the patio. Travertine stone will be used in the <br />construction of the patio. A drywell will be installed near the patio to catch storm water runoff. The <br />proposed project also includes the adjustment of the float from a horizontal position to a vertical <br />position using the existing piles. <br /> <br />The Agent reviewed the project on photos and stated the harbormaster and shellfish warden have <br />no issues. He stated there will be no impact to the resource area. <br /> <br />No comment from the public <br /> <br />Motion: Mr. Sweet moved a Negative Determination, seconded by Mr. O’Neill. Vote <br />unanimous 4-0 <br /> <br />6:03 Thomas Smith (Applicant), 1437 Great Hay Road. Proposed aquaculture project in <br />Great River. Owner of record United States of America. At request of applicant, continued <br />from 3/22, 4/26 to obtain local and state approval/permits. NOI <br /> <br />The Agent stated the applicant has requested a continuance due to the fact he hasn’t received a <br />letter from the Division of Marine Fisheries or Board of Selectmen approval. <br /> <br />Motion: Mr. Sweet moved to continue the hearing at the request of the applicant to July 26 <br />at 6:03 p. m., seconded by Mr. O’Neill. Vote unanimous 4-0 <br /> <br />6:06 NJCJ, LLC, 21 Metacomet Road. Proposed pier, ramp and float. At request of <br />applicant, continued from 5/10 to address Harbormaster and Shellfish Constable concerns. <br />NOI <br /> <br />Resource Area: Land Under Ocean, Land Containing Shellfish, Coastal Bank, Coastal <br />Beach, Salt Marsh, BVW, LSCSF. <br /> <br />Michael Borselli, Falmouth Engineering, represented the applicant. He noted this hearing was <br />continued from May 10, 2018. He stated he has submitted a revised plan depicting the reduction <br />in the length of the dock and the elimination of the boat lift. He showed the changes on the plan <br />including the elimination of the “T” on the dock. With these changes there will be a reduction in the <br />number of piles from 18 to 8. <br /> <br />The Agent stated the Shellfish Warden’s comments came in late today which stated the dock <br />proposed is in a highly productive shellfish area. The Shellfish Warden recommended a ramp from <br />shore to a float to eliminate pilings in the shellfish area which would negatively impact shellfish <br />productivity by reducing habitat area. The revised plan has two pilings in the shellfish area with a <br />24’ ramp to the float. The Shell Warden said these two pilings could be eliminated if the walkway <br />was shortened and a 40’ ramp was used instead. The Agent recommended continuing with the <br />hearing and the applicant can work things out with Mr. York. He said he didn’t think it was fair to <br />the applicant to be notified today about his concerns with the two piles. <br /> <br />
