Mr. Borselli felt the two pilings have no significant impact on the shellfish habitat and they would <br />prefer not to change the ramp which would be an additional cost. The Agent stated the <br />harbormaster had concerns with the nearby moorings and Mr. Borselli stated his applicant will work <br />with the harbormaster on his concerns regarding the moorings. <br /> <br />Public Comments <br /> <br />Mr. Mark Burtis was representing the neighbors. He said there are several concerns. There is a <br />tidal pool, proximity to the moorings, the narrow channel and the tons of shellfish in the area. It <br />was noted that the Commission has no say in the navigation. They rely on the harbormaster <br />regarding navigation. Mr. Burtis stated there is actually two tidal pools which have a lot of life in <br />them and the dock will have an impact on the tidal pool. The Agent reviewed the regulation of land <br />under salt water, and salt ponds. He said the plan needs to have a delineation of the area of the <br />salt ponds. The Agent questioned whether two piles would have an adverse impact that couldn’t <br />be mitigated for. <br /> <br />Mr. Borselli said he would be happy to delineate the salt ponds. He reviewed the project on the <br />plans and said they have filed the project with the Division of Marine Fisheries. He said he sees no <br />negative impact. <br /> <br />The Agent said there should be a conversation with Rick York, the Shellfish Constable and if he <br />has an issue the Commission should support that. <br /> <br />Following a lengthy discussion, the Commissioners generally agreed that Mr. Borselli sit down with <br />the shellfish warden and the shellfish commission to see if they can work the differences out and <br />come up with a viable solution. <br /> <br />Craig Robert, neighbor, was concerned about the clearcutting that was done in the area. The <br />Agent stated mitigation was required and everything has been planted and the results will not be <br />seen in the first year. They have three years and it is thoroughly watched. He was also concerned <br />with the moorings and the Agent stated that is why the harbormaster has concerns and it will be <br />addressed. <br /> <br />Motion: Mr. Sweet moved to Close and Issue with the stipulation there will be a <br />consultation between the Shellfish Warden and the Conservation Agent and also that the <br />Tidal Pools be delineated on the plan, seconded by Mr. O’Neill. He explained the proposed <br />project is to construct and addition within the existing deck area. All work is proposed to be located <br />within previously legally altered areas. The Agent reviewed the Board of Health does not require <br />an application. He showed photos of the area and stated there are no disturbances to the <br />resource areas. <br /> <br />No comment from the public <br /> <br />Motion: Mr. Sweet moved a Negative Determination, seconded by Mr. O’Neill.
