MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> DECEMBER 12,2018 <br /> Mr. Lippman requested a continuance until January 9, 2019. <br /> Mr. Bonvie made a motion to accept the request for continuance by Mr. Lippman until <br /> January 9, 2019. The motion included that the Board will read all the Town Department <br /> comments into the record at the continued hearing. Mr. Gould seconded. All were in favor <br /> to continue the hearing until January 9, 2019. <br /> 439 Nathan Ellis Hiahway (Unit 6): Petitioner, Katarina Kumbatiadis requests a Special <br /> Permit under §174-25 E (7) of the Zoning Bylaws to allow for a dog grooming and dog <br /> day care business on property located in C2 Zoning District, (Map 72 Parcel 23),Mashpee, <br /> MA, (Owner of record: Brickyard Marketplace Nominee Trust). <br /> Katarina addressed the Board and said that her dog daycare business Captivating Canines <br /> has been running for over eight years by the former business owner that was never <br /> permitted. She took over the business thinking that all the permits were in place, but the <br /> Building Department could not find a Special Permit for the original established business. <br /> She provided the copy of the sign permit that was approved but there is no record of a <br /> special permit. <br /> Mr. Mendoza said this is a preexisting use, but there's no record of it going in front of the <br /> ZBA. If the Board sees fit to grant,the permit will go with the property. <br /> Mr. Furbush asked if the business has changed in any way since the previous owner. <br /> Katarina said that they will providing the same services. There will be no boarding of any <br /> dogs. <br /> Sharon asked the Board members if there were any health issues with the business being <br /> next door to a restaurant. She also had concerns with young children because the business <br /> abuts a residential neighborhood. <br /> Mr. Mendoza had a conversation with the Health Agent and he has no issues because it's <br /> been an established business. This is just a change of ownership. <br /> Mr. Furbush asked the applicant how the daycare business works. Katarina said that she <br /> provides daycare for half-day or a full-day (4 hrs. or 8 hrs.). She said the dogs are inside, <br /> but are in one area. She said she generally has one or two dogs at a time. <br /> Mr. Goldstein read the Board of Health comments into the record. <br /> Mr.Furbush asked what happens with the dog waste.Katarina said she has bags and regular <br /> trash dumpster in the back. <br /> Mr. Furbush read the special permit requirement bylaw. He asked how they will handle the <br /> noise. <br /> 9 <br />
