NOI <br /> Matt Costa, Cape & Islands Engineering, represented the applicant. He requested a <br /> continuance until May 23, 2019 at 6:00 p.m. <br /> Motion: Mr. O'Neill moved to continue the hearing to May 23, 2019 at 6:00 p.m., <br /> seconded by Mr. Dalton. Vote unanimous 4-0 <br /> 6:24 Jennifer B. Brandwein & David Goldman, Trustees, 233 Hooppole Road. <br /> Permit an existing pier, ramp and tee structure. RDA <br /> Resource Area: Land Under Waterbodies and Waterways, John's Pond <br /> Matt Costa, Cape & Islands Engineering, represented the applicants. He stated the <br /> proposal is to obtain a permit for an existing pier, ramp and tee structure. This dock didn't <br /> have a Chapter 91 license and in order to get one we need approval from the <br /> Conservation Commission. The structure has been there for more than 20 years and the <br /> property has recently changed hands. He noted the dock is a seasonal dock and there is <br /> no proposed work to take place. <br /> The Agent stated this dock is a grandfathered dock and is exempt from Natural Heritage <br /> review. The home address needs to be displayed on each separate portion of the dock <br /> and that the dock be put in the same place every year so it doesn't disturb any additional <br /> habitat for freshwater mussel. <br /> No comment from the public <br /> Motion: Mr. Smith moved a Negative Determination to include the conditions as <br /> outlined by the Conservation Agent, seconded by Mr. Dalton. Vote unanimous 4-0 <br /> 6:27 John & Constance M. Henry, 21 Kim Path. Proposed construction of new deck <br /> onto existing dwelling. RDA <br /> Resource Area: LSCSF, Buffer Zone to BVW, Land Under Waterbodies, Dennis <br /> Pond <br /> Mark Clancy, Clancy & Castano, represented the applicants. He explained the proposal is <br /> to construct a new ground level sun deck which will be 16' by 20' off the back of the <br /> existing single-family home. The construction will include digging new footings below <br /> deck. The deck will be installed on existing lawn, previously disturbed area. <br /> The Agent reviewed the property location and showed photos of the area where the deck <br /> will be constructed. He noted the plan the applicant used was a plan from another <br /> engineer and requested Mr. Clancy obtain a letter from Engineering Works giving him <br /> permission to use their plan. He stated the project is outside of the 50' buffer and does not <br /> require mitigation. <br /> No comment from the public <br /> Motion: Mr. Smith moved a Negative Determination with the condition that the <br /> permission to use the plan be obtained from Engineering Works, seconded by Mr. <br /> Dalton. Vote unanimous 4-0. <br />
