9
Community Preservation Committee
Minutes
December 18, 2018
NEW BUSINESS
Deliberations on May 201.9Project Proposals: (continued)
Restoration of the Parsonaue: $400,000: (continued)
If the restoration of The Parsonage project was to proceed forward, the Community Preservation
Committee recommended that a Memorandum of Understanding(MOU) be developed and
agreed upon by the Town and Tribe to determine the number of days/events per year the building
would be open to the public since the project would be improved upon with public funding.
The expenditure of CPA funds would be subject to the MOU to ensure full funding is available
and secured for the $700,000 project before the Town of Mashpee would expend any CPA funds.
It is also required under the mandates of M.G.L. Chapter 180 that a perpetual preservation
restriction would be required and filed with the Barnstable County Registry of Deeds to protect
the Town's investment of funds. The deed rider would most likely require input from the
Federal government, the deeded owner of the subject property on behalf of the Mashpce
Wampanoag Tribe.
In further questioning this project with the use of CPA funds, it was agreed that an opinion from
Town Counsel would be obtained regarding the scope of the MOU, applicability of interest,
ability to obtain a preservation restriction and method to navigate this project when it is owned
by the Federal government.
The matter was taken under advisement at this time.
AHT- Transfer of Funds to Affordable Housing Trust: $300,000:
It was disclosed the Affordable Housing Trust took action on March 24, 2014 to develop a
Declaration of Trust pursuant to the provisions of M.G.L. Chapter 44, §55C. The certificate of
trust named the Mashpee Affordable Housing Trust if required to be recorded with the
Barnstable County Registry of Deeds and the Barnstable County Registry District of Land Court.
When searching online, there is no record of the Declaration of Trust, book and page not found.
