9 <br /> Community Preservation Committee <br /> Minutes <br /> December 18, 2018 <br /> NEW BUSINESS <br /> Deliberations on May 201.9Project Proposals: (continued) <br /> Restoration of the Parsonaue: $400,000: (continued) <br /> If the restoration of The Parsonage project was to proceed forward, the Community Preservation <br /> Committee recommended that a Memorandum of Understanding(MOU) be developed and <br /> agreed upon by the Town and Tribe to determine the number of days/events per year the building <br /> would be open to the public since the project would be improved upon with public funding. <br /> The expenditure of CPA funds would be subject to the MOU to ensure full funding is available <br /> and secured for the $700,000 project before the Town of Mashpee would expend any CPA funds. <br /> It is also required under the mandates of M.G.L. Chapter 180 that a perpetual preservation <br /> restriction would be required and filed with the Barnstable County Registry of Deeds to protect <br /> the Town's investment of funds. The deed rider would most likely require input from the <br /> Federal government,the deeded owner of the subject property on behalf of the Mashpce <br /> Wampanoag Tribe. <br /> In further questioning this project with the use of CPA funds, it was agreed that an opinion from <br /> Town Counsel would be obtained regarding the scope of the MOU, applicability of interest, <br /> ability to obtain a preservation restriction and method to navigate this project when it is owned <br /> by the Federal government. <br /> The matter was taken under advisement at this time. <br /> AHT- Transfer of Funds to Affordable Housing Trust: $300,000: <br /> It was disclosed the Affordable Housing Trust took action on March 24, 2014 to develop a <br /> Declaration of Trust pursuant to the provisions of M.G.L. Chapter 44, §55C. The certificate of <br /> trust named the Mashpee Affordable Housing Trust if required to be recorded with the <br /> Barnstable County Registry of Deeds and the Barnstable County Registry District of Land Court. <br /> When searching online, there is no record of the Declaration of Trust, book and page not found. <br />
