MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JANUARY 9, 2019 <br /> Ken Brivogel with Jack Landers-Cauley Engineering represented Carl Cavossa, the <br /> homeowner who was also present. He is requesting a Special Permit for a dock that extends <br /> more than 70 ft. over the waterway. Mr. Brivogel submitted a proposed plan dated April <br /> 19, 2018 which shows the proposed dock, which is the plan that was approved by the <br /> Conservation Commission. <br /> Mr. Furbush reviewed the existing and proposed plans and did not see a difference. He <br /> received an email with plans attached from John Ryll, with Landers-Cauley. Jon reviewed <br /> the distance on the proposed plan as 80.0 ft. from the opposite side of the waterway. The <br /> existing plan showed 89 ft. He asked if the dock was being moved further into the <br /> waterway. <br /> Mr. Brivogel said that the proposed dock is 47.9 ft. extending out from the shore. The <br /> existing dock is 40 ft. He said that the existing dock is an "L" shaped that has a ramp that <br /> is 16 ft. and two floats 8 by 8,the"L"is parallel to the shore. The line drawn from the dock <br /> located to the south, and extended that line to the corner of the dock to the north. This <br /> proposed dock does not go further into the waterway. He said they recently filed a notice <br /> of intent on February 6,2018. This notice was submitted to the Harbormaster,the Shellfish <br /> Warden, and the Waterways Commission. <br /> There was a hearing on March 22, 2018 with Conservation, that meeting was continued <br /> until April 26, 2018. He spoke with Mr. York, Mr. Everett, and Mr. Cavossa to discuss <br /> their concerns. Mr. Cauley later spoke with Drew McManus about redesigning the dock <br /> and what would meet the Conservation's requirements. The dock was redesigned as <br /> proposed,and the plan was submitted to Conservation which is the April 19,2018 revision. <br /> The order of conditions was issued on May 15, 2018. <br /> Mr. Furbush asked Mr. Brivogel what the comments were from the Harbormaster and the <br /> Shellfish Constable, and asked if he had a conversation with Alex Turner who was the <br /> Harbormaster at the time the project was proposed with Conservation. <br /> Mr. Brivogel said that the Harbormaster thought there might be an issue with passage in <br /> the waterway, and that it might contribute to congestion. Mr. Brivogel said that this is not <br /> true because it doesn't extend any further than the existing dock from the north to the south. <br /> Mr. Furbush read the comments submitted by Alex Turner, and Ashley Fisher, Shellfish <br /> Constable. <br /> Mr. Cavossa said that the mitigation was 1 ft. by 1 ft., and he was asked to remove two <br /> pilings. He said he removed and mitigated one piling 12" x 12" and had not heard back <br /> from the Shellfish Constable at the time.He said that he filed for a Chapter 91 License,and <br /> was told he had to file a hearing with the Zoning Board. He said it's been over a year since <br /> he filed with Conservation. <br /> 6 <br />
