NOI <br /> The Agent informed the Commissioners the applicants have requested a two week <br /> continuance, r <br /> Motion: Mr. McKay moved to continue the hearing at the request of the applicant <br /> to May 11 at :09 p.m., seconded by Mr. Shaw. Vete unanimous -0 <br /> :21 Discussion, Vote to rescind Regulation 30 of Chapter 172 of the Mash pee <br /> Code. <br /> The Agent requested this regulation be rescinded. He said Regulation 30 of Chapter <br /> 1is the Prevention of Pollution — Effect of Nutrient Loading on Waterbodies. He <br /> referred to the feedback and objection letters from AM Wilson Associates and the <br /> Monomoscoy Improvement Trust; The regulation calls for a performance standard of <br /> achieving an output of 5 parts per million on "any construdtion" on a given lot. He said it <br /> is a very vague regulation as to its scope. It requires significant effort for any <br /> development regardless of size or scope and the 5 parts per million is unachievable. He <br /> said we have standards in other regulations: Board of Health for septic systems and <br /> wastewater, standards for lawn fertilizer irrigation and as far as storm water runoff and <br /> roof runoff capture} those are already conditioned in any given application. The Agent <br /> stated the rescindment of this regulation does not require a town meeting vote. We must <br /> provide a. notice in the local newspaper,of the public meeting and open it up to public <br /> comment. Fallowing a discussion, the chair opened the discussion up to public <br /> comment. <br /> Public <br /> Tiny McNamara commented this regulation is redundant and we already have laws in <br /> place and agreed the rescission is a good decision. <br /> Motion: Mr. smith moved to rescind Regulation 172-30, seconded by Mr. McKay. <br /> Vote unanimous 6-0 <br /> P R EIPOST-H EARI N AGENDA.: <br /> PRESENTATION: ATV intrusion on Johns Bond presented by Timothy McNamara. <br />
