1 <br /> L; <br /> Motion: Mr. McKay moved a Negative Determination, seconded by Mr. cooly, vote <br /> unanimous 4-0 <br /> 6:09 Jay J. and Elizabeth A. Derenzo, 134' Popponesset Island load. Proposed <br /> demolition and reconstruction of a dwelling, garage, swimming pool and septic <br /> system along with hardscape and landscape improvements. continued from <br /> 4127/2017 for homeowner to resolve wetland violation. <br /> Resource Area: Lscs E, Buffer Zone to coastal hank, coastal dune, salt marsh <br /> and Land tender ocean <br /> Tori Bunker, BSS Design along with Andrew Garulay, Yarmouth Port Design Group, <br /> represented the applicants. Mr. Bunker explained the original Nol has expired. He <br /> explained the proposed project is to demolish the existing single family house with <br /> driveway. The work limitt limitwill be staled; erosion control will be installed and selected <br /> trees and shrubs will be removed. A new septic system will be installed and the existing <br /> cesspool will be filled with sand. The proposed driveway will consist of crushed stone <br /> and a swimming pool and patio will be installed. All areas disturbed will be stabilized <br /> and restored and any disturbed lawn areas will be restored according to theTown of <br /> Mashpee lawn standards. He noted the project meets the performance standards. <br /> Mr. Garulay explained the landscape plan for this project which was similar to the <br /> original plan. He noted the plantings that were to be used. He noted the driveway is a <br /> semi-circular drive which goes up 5 or more feet. The slope is pitched with a grass <br /> swale to collect the runoff, <br /> The Agent noted there was a lame cedar tree cut down in the coastal dune area.and the <br /> homeowner stated he didn't know when it was cut or who cut it but since he is the <br /> homeowner he is responsible. The Agent said what he decided to do is handle it <br /> through arc Enforcement Order outside of this hearing because they are two separate <br /> issues. He recommended the planting of beach -grass in the coastal dune area as <br /> mitigation (among other suitable plantings). The Enforcement Order has to be drafted <br /> and sent out with conditions and timelines for a planting plan and execution of that plan <br /> accompanied by a 3 year monitoring period to ensure survival of the mitigation. <br /> The Agent noted the plan was previously. approved by the Commission. It is an <br /> improvement from the existing conditions of the lot. He showed pictures noting it will <br /> give more space away from the bank. Any grass areas will have to adhere to the <br /> Mashpee lawn standards. The Board of Health comments stated the project is not in <br /> Zone II. A conventional Title v system is proposed to accommodate an existing <br /> bedroom dwelling and has been approved. It was suggested the plan needs to show the <br /> grading of the driveway. <br /> No comment from the public <br /> Motion: Mr. McKay moved to close and Issue with the condition that the violation <br /> mitigation plan he submitted prior to issuance of ooc and to submit a reprised <br /> plan showing the grading of the driveway, seconded by Mr. Shaw. vote 4.0 <br /> 3 <br />
