There appears to be a lack of management
on the job. Most of the problems have stemmed from the sub-contractors
due to lack of supervision. With adequate supervision, the quality of
the construction canned be controlled indicated Mr.Hauck,
Town Counsel,Attorney David Doneski was present to address this
matter with the Board. Attorney Doneski recommended to formally
reference the terms of the bond with Liberty Mutual Insurance Company,
the bonding company for the High School building project.
Attorney Doneski indicated that an additional 20 days after the receipt
of the letter is necessary to terminate Stone's contract. Stone would then
have seven days to clear the default before the contract is terminated.
It was noted that the bonding company would have the option to maintain
Stone and its contractors or bring in an entire new company to complete
the building project.
Attorney Doneski indicated that if Stone Building is retained to work for
the bonding company,Liberty Mutual must gain prior approval from the
Town to pursue this option.
Mr.Griffin indicated that the Town sent a letter to Liberty Mutual on
January 3, 1996 stating that the contract would be in default if thep resent
situation is not rectified.
z Attorney Doneski indicated that he will address the formal notification
matter with the Liberty Mutual Insurance Company.
t Motion made by Selectman Dinizio to declare Stone Building
Company, the contracting firm for the High School building
project, in default of its contract with the Town of Mashpee.
Motion seconded by Selectman Mills.
VOTE: Unanimous, 4-0.
